{"data":{"id":"us-ky/krs-18a.032","jurisdiction":"us-ky","citation":"KRS 18A.032","heading":"Applicants to and eligibles for the classified service -- Examination --","body":"Placement on and removal from registers -- Certification for employment.\n(1) Except as provided by the provisions of this chapter, the secretary may refuse to\nexamine an applicant; or, after examination, may disqualify an applicant, remove\nhis or her name from a register, refuse to certify any eligible on a register, or may\nconsult with the appointing authority in taking steps to remove the person already\nappointed if:\n(a) It is found that he or she does not meet any one (1) of the preliminary\nrequirements established for the examination for the class of position;\n(b) He or she is unable to perform the duties of the class;\n(c) He or she has made a false statement of material fact in his or her application;\n(d) He or she has used or attempted to use political pressure or bribery to secure\nan advantage in the examination;\n(e) He or she has directly or indirectly obtained information regarding the\nexamination to which, as an applicant, he or she was not entitled;\n(f) He or she has failed to submit his or her application correctly or within the\nprescribed time limits;\n(g) He or she has taken part in the compilation, administration, or correction of\nthe examination for which he or she is an applicant;\n(h) He or she has previously been dismissed from a position in the state service\nfor cause or has resigned while charges for dismissal for cause of which he or\nshe had knowledge were pending;\n(i) He or she has been convicted of a fel ony within the preceding five (5) years\nand his or her civil rights have not been restored or he or she has not been\npardoned by the Governor;\n(j) He or she has been convicted of a job related misdemeanor, except that\nconvictions for violations of traffic regulations shall not constitute grounds for\ndisqualification; or\n(k) He or she has otherwise willfully violated the provisions of this chapter.\n(2) An eligible may be removed from a register:\n(a) If the eligible cannot be located by postal authorities at the last address\nprovided by the eligible;\n(b) If the eligible responds in writing that he or she no longer desires\nconsideration for position in that class;\n(c) If the eligible declines an offer of probationary appointment to the class for\nwhich the register was established;\n(d) If it is shown that the eligible is not qualified or is unsuitable for appointment\nto the class for which the register is established;\n(e) If the eligible fails to reply within a period of ten (10) calendar days of the\nreceipt of the written request of the appointing authority for an interview, or\nfails to appear for an interview which he or she has scheduled with the\nappointing authority without good cause;\n(f) If the eligible accepts an appointment and fails to present himself or herself\nfor duty at the time and place agreed to without giving reasons for the delay\nsatisfactory to the appointing authority;\n(g) If the eligible states in writing that he or she is not available for appointment\nor does not wish to be considered for appointment; or\n(h) If the eligible demonstrates erratic, unsafe, or threatening behavior.\n(3) When an eligible notifies the cabinet in writing that he  or she is unavailable for\nemployment or employment consideration, the cabinet may remove the name of\nthat eligible from the appropriate register without further notification to the person.\n(4) When the cabinet is notified in writing by an appointing autho rity that an eligible\nhas accepted a bona fide offer of probationary appointment to any position,\neffective on a specified date, his or her name may be removed from the register for\nall classes for which the maximum salary is the same or less than that of the class to\nwhich he or she has been appointed.","path":["KRS Chapter 18A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53723","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:39Z","sha256":"d4578838c9c1b0fbaf98eb317efe6bc2711ab7a4a91266a77a08cab249f0554e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-18a.030","next":"us-ky/krs-18a.035"},"notice":"GroundRules: Original legal text.
