{"data":{"id":"us-ky/krs-18a.035","jurisdiction":"us-ky","citation":"KRS 18A.035","heading":"Delegation of secretary's powers -- Assistance in testing -- Membership on","body":"Kentucky Employees Retirement System board.\n(1) The secretary may from time to time designate in writing an employee of the\ncabinet to act for him in case of his absence or inability from any cause to discharge\nthe powers and duties of his position. In this case, the powers and duties of the\nsecretary shall devolve upon his designee.\n(2) The secretary may request appropriate persons, including officers and employees in\nthe state service, to assist in the preparation and rating of tests. Department heads\nshall cooperate to the fullest extent possible in making the services of their\nemployees available for such work.\n(3) (a) The secretary may enter into written agreements with  an appointing authority\nwhich would provide for the delegation of his authority and power to the\nappointing authority. The secretary is prohibited from delegating any powers\nor authority pertaining to disciplinary actions, lay-offs, or registers.\n(b) All written agreements delegating the secretary's power and authority as\nprovided in paragraph (a) of this subsection shall be specific in nature and\nrenewed annually.\n(c) A copy of the written agreements shall be forwarded to the Personnel Board.\n(4) The secr etary shall serve ex officio as a member of the board of trustees of the\nKentucky Employees Retirement System.","path":["KRS Chapter 18A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1344","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:39Z","sha256":"73b843c43bd9cc9d76f30680acb002dbba476b7ffd2bf91b59ec4a630e1d7092","source_id":"us-ky","stale":false,"prev":"us-ky/krs-18a.032","next":"us-ky/krs-18a.037"},"notice":"GroundRules: Original legal text.
