{"data":{"id":"us-ky/krs-18a.075","jurisdiction":"us-ky","citation":"KRS 18A.075","heading":"Duties of Personnel Board.","body":"Subject to the provisions of this chapter and KRS Chapter 13A, it shall be the duty of the\nboard to:\n(1) As provided by this chapter, promulgate comprehensive administrative regulations\nconsistent with the provisions of KRS 18A.005 to 18A.200, and with fed eral\nstandards for the administration of a personnel system in the agencies of the state\ngovernment receiving federal grants for the purpose of carrying out the provisions\nof this chapter;\n(2) Make investigations, either on petition of a citizen, taxpayer,  interested party, or on\nits own motion, concerning the enforcement and effect of KRS 18A.005 to\n18A.200, and to require observance of its provisions and the administrative\nregulations promulgated pursuant to the provisions of this chapter and KRS Chapter\n13A; and to make such investigation as may be requested by the General Assembly\nor the Governor and to report thereon;\n(3) Hear appeals from applicants for positions for which examinations are being or\nhave been conducted, from eligibles on examination reg isters, from unclassified\nemployees who have been dismissed, demoted, suspended, or reduced in pay or\ngrade for cause, and from officers or employees serving under the personnel\nsystems created by this chapter, as provided by 1986 Acts Ch. 494;\n(4) In cooperation with the secretary, promote public understanding of merit principles\nin government service;\n(5) Present, in accordance with the provisions of KRS Chapter 48, budget requests for\nthe support of the personnel board;\n(6) Make annual reports to the Gov ernor, the Legislative Research Commission, the\nsecretary of the Personnel Cabinet, and the co-chairs of the Interim Joint Committee\non State Government prior to October 1. The board shall make biennial reports to\nthe General Assembly, which reports shall be a public record freely available to\nthose persons interested in obtaining a copy. The board may request state agencies\nto provide information to assist the board in compiling the reports, which shall\ninclude the following:\n(a) The number of merit state employees at the beginning and the end of the\nreporting period;\n(b) The total number of grievances filed and mediation requests made by merit\nemployees during the reporting period;\n(c) A tabulation of the stages in which employee complaints were resolved during\nthe reporting period; and\n(d) The average amount of time taken to resolve employee complaints during the\nreporting period, by stage;\n(7) Advise the Governor and the secretary with  respect to the administration of the\npersonnel system created by this chapter;\n(8) Consider and act on such matters as may be referred to the board by the secretary;\n(9) Represent the public interest in the improvement of personnel administration in the\nstate service, and advise and assist the secretary in fostering the interest of\ninstitutions of learning and of civic, professional, and employee organizations in the\nimprovement of personnel standards in the state service; and\n(10) Make a determination, up on receiving notification of proposed classification\nselection method changes with proper documentation for the necessity for the\nchange from the secretary, on classification selection method changes prior to those\nchanges occurring. Upon receiving a class ification selection method change\nproposal from the secretary, the board shall, at its next regularly scheduled monthly\nmeeting, review and comment on proposed selection method changes.
