{"data":{"id":"us-ky/krs-18a.0751","jurisdiction":"us-ky","citation":"KRS 18A.0751","heading":"Personnel Board -- Regulatory authority.","body":"(1) The board shall promulgate comprehensive administrative regulations for the\nclassified service governing:\n(a) Appeals by state employees;\n(b) Demotion;\n(c) Dismissal;\n(d) Fines, suspensions, and other disciplinary measures;\n(e) Probation, provided that the  board may not require an initial probationary\nperiod in excess of six (6) months except as provided in subsection (4)(e) of\nthis section and KRS 18A.005;\n(f) Promotion;\n(g) Reinstatement;\n(h) Transfer; and\n(i) Employee grievances and complaints.\n(2) (a) These administrative regulations shall comply with the provisions of this\nchapter and KRS Chapter 13A, and shall have the force and effect of law,\nwhen approved by the board, after compliance with the provisions of KRS\nChapters 13A and 18A and the procedures adopted thereunder;\n(b) Administrative regulations promulgated by the board shall not expand or\nrestrict rights granted to, or duties imposed upon, employees and\nadministrative bodies by the provisions of this chapter; and\n(c) No administrative body , other than the personnel board, shall promulgate\nadministrative regulations governing the subject matters specified in this\nsection.\n(3) Prior to filing an administrative regulation with the Legislative Research\nCommission, the board shall submit the adm inistrative regulation to the secretary\nfor review:\n(a) The secretary shall review the administrative regulation proposed by the board\nnot more than twenty (20) days after its submission to him or her;\n(b) Not more than five (5) days after his review, the secretary shall submit his or\nher recommendations in writing to the board;\n(c) The board shall review the recommendations of the secretary and may revise\nthe proposed administrative regulation as it deems necessary; and\n(d) After the board has completed th e review provided for in this section, it may\nfile the proposed administrative regulation with the Legislative Research\nCommission pursuant to the provisions of KRS Chapter 13A.\n(4) These administrative regulations shall provide:\n(a) For the procedures to be utilized by the board in the conduct of hearings by\nthe board, consistent with the provisions of KRS Chapter 13B;\n(b) For reduction in rank or grade as provided by this chapter;\n(c) For discharge, as provided by this section;\n(d) For imposition, as disc iplinary measures, of a fine of not more than ten (10)\nworking days' pay, or for suspension from the service without pay for no\nlonger than thirty (30) working days and, in accordance with the provisions of\nKRS 18A.095, for the manner of notification of the employee of the discipline\nand his or her right of appeal;\n(e) No probationary period may exceed twelve (12) months, except as provided in\nKRS 18A.005. The secretary may recommend an initial probationary period\nin excess of six (6) months for specific jo b classifications to the board. This\nrecommendation shall take the form of a proposed administrative regulation\nthat shall be submitted to the board for approval. The subject of the\nadministrative regulation shall be limited to job classifications for whic h an\ninitial probationary period in excess of six (6) months is required and shall\nspecify:\n1. The job classification for which an initial probationary period in excess\nof six (6) months is required; and\n2. The specific number of months constituting the in itial probationary\nperiod for the job classification. No other administrative regulation shall\ninclude any provision prescribing an initial probationary period in\nexcess of six (6) months, except as provided in KRS 18A.005. Upon\napproval by the board of th e proposed administrative regulation\nprovided for in this paragraph, the board shall file the regulation with\nthe Legislative Research Commission as provided by KRS Chapter 13A;\n(f) For promotions which shall give appropriate consideration to the applicant 's\nqualifications, record of performance, conduct, and seniority. Except as\nprovided by this chapter, vacancies shall be filled by promotion whenever\npracticable and in the best interest of the service;\n(g) For reemployment of laid-off employees in accordance with the provisions of\nthis chapter;\n(h) For transfer from a position in one (1) department to a similar position in\nanother department involving similar qualifications, duties, responsibilities,\nand salary ranges as provided by the provisions of KRS 18A.113;\n(i) For establishment of a plan for resolving employee grievances and\ncomplaints. This plan shall not restrict rights granted employees by the\nprovisions of this chapter;\n(j) For promotion of career employees to positions in the unclassified servic e\nwithout loss of status to the individual employees so promoted, as provided by\nthis chapter; and\n(k) For any other administrative regulations not inconsistent with this chapter and\nKRS Chapter 13A as may be proper and necessary for its enforcement.","path":["KRS Chapter 18A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53730","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:39Z","sha256":"f08300f89f3372d9c8ec3a79e0604ee687aa1af1048cbcee4f856379ba0202c3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-18a.075","next":"us-ky/krs-18a.080"},"notice":"GroundRules: Original legal text.
