{"data":{"id":"us-ky/krs-18a.105","jurisdiction":"us-ky","citation":"KRS 18A.105","heading":"Compensation, retirement system contributions of employee ordered","body":"reinstated without loss of pay.\n(1) (a) When a classified or unclassified employee has been finally ordered reinstated\nby the board without loss of pay, pursuant to the provisions of KRS 18A.095,\nthe executive director of the board shall forward a certified copy of said order\nto the Personnel Cabinet and the Finance and Administration Cabinet, which\nshall process proper payment to the employee for the period of suspension,\nsaid paym ent to be made out of the agency's appropriations. If no funds or\ninsufficient funds are available in the agency's appropriations, then payment\nshall be made out of the \"judgments\" section of the general fund of the\nbiennial state budget.\n(b) Gross moneys which were earned by the employee from other sources during\nthe period of suspension shall be set -off against the gross sum due the\nemployee, to the extent that the moneys were earned in a number of hours\ncomparable to the length of time the employee would  have worked in the job\nfrom which he was dismissed. The Finance and Administration Cabinet shall\nby regulation provide an administrative procedure for determining reasonable\nearnings to be so set off.\n(c) All other deductions shall be deducted as required  by law or by Finance and\nAdministration Cabinet regulation.\n(2) (a) Both the employee's and employer's contributions to the Kentucky Employees\nRetirement System shall be based upon the gross amount due the employee,\nbefore set off or deduction, except for  set-off caused by earnings on which\nemployee and employer contributions to the Kentucky Employees Retirement\nSystem, County Employees Retirement System, State Police Retirement\nSystem, or Kentucky Teachers' Retirement System have been paid.\n(b) Member and  employer contributions paid into the system in which the\nemployee participated after dismissal shall be transferred to the system in\nwhich he participated prior to his illegal dismissal. In the event of a difference\nin member or employer contribution rate s between the retirement system\nunder which the member was covered prior to dismissal and the retirement\nsystem in which he participated before reinstatement by the board, the\nmember and employer shall pay or receive a refund in order to adjust their\nrespective contribution to the appropriate rate for the system under which he\nwould have participated had he not been dismissed.","path":["KRS Chapter 18A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1362","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:39Z","sha256":"de683483a7890b2033c0724f27bcfbdbc240f7b62e9e66d2906b4778f4f90064","source_id":"us-ky","stale":false,"prev":"us-ky/krs-18a.100","next":"us-ky/krs-18a.110"},"notice":"GroundRules: Original legal text.
