{"data":{"id":"us-ky/krs-18a.113","jurisdiction":"us-ky","citation":"KRS 18A.113","heading":"Layoff, furlough, and reduction -in-hours rules -- Notice -- Reemployment","body":"-- Administrative regulations.\n(1) As used in this section:\n(a) \"Furlough\" or \"reduction in hours\" means the temporary reduction of hours an\nemployee is scheduled to wor k by the appointing authority within a pay\nperiod; and\n(b) \"Layoff\" means discharge of employment subject to the rights contained in\nthis section.\n(2) An appointing authority shall have the authority to layoff or furlough employees or\nreduce hours of employment for any of the following reasons:\n(a) Lack of funds or budgetary constraints;\n(b) A reduction in spending authorization;\n(c) Lack of work;\n(d) Abolishment of a position;\n(e) Efficiency; or\n(f) Other material change in duties or organization.\n(3) The appointing authority shall determine the classifications affected, the number of\nemployees laid off in each classification, and each county to which a layoff applies.\nIn the same department or office, county, and job classification, interim and\nprobationary employees shall be laid off before full -time or part -time employees\nwith status. For purposes of layoff, \"probationary employee\" shall not include an\nemployee with status serving a promotional probation.\n(4) The provisions of this section shall not a pply to federally funded time -limited\nemployees.\n(5) The secretary of the Personnel Cabinet shall approve all actions taken under\nsubsection (2) of this section and no such layoff, furlough, or reduction of hours\nmay begin until the approval has been grant ed. The appointing authority, with the\napproval of the secretary, shall have the authority to determine the extent, effective\ndates, and length of any action taken under subsection (2) of this section.\n(6) In determining a layoff, the appointing authority shall consider all employees under\nthe same appointing authority, within the classification affected, and within the\ncounty affected. Consideration shall be given to the following relevant factors and\nin this order:\n(a) Job performance evaluations;\n(b) Education, training, and experience;\n(c) Disciplinary record; and\n(d) Seniority.\n(7) Any classified employee with status whose position is subject to layoff, furlough, or\nreduction of hours shall be provided written notice containing the reason for the\naction at least thirty (30) days in advance of the effective date of the action.\n(8) (a) Any classified employee with status who is laid off shall be eligible to apply\nas a reemployment applicant for the job classification from which he or she\nwas laid off, in t he cabinet from which he or she was laid off for a period of\ntwo (2) years. A reemployment applicant shall be hired before any applicant\nexcept another reemployment applicant with greater seniority who is on the\nsame register.\n(b) A reemployment applicant shall not be removed from any register except as\nprovided in KRS 18A.032.\n(c) When a reemployment applicant is removed from a register, he or she shall be\nnotified in writing or electronically and shall have the right to appeal to the\nboard within thirty ( 30) calendar days after receipt of the notification,\nexcluding the day he or she receives notice.\n(d) A reemployment applicant who accepts any classified position, or who retires\nthrough the Kentucky Employees Retirement System or Kentucky Teachers'\nRetirement System, shall cease to have eligibility rights as a reemployment\napplicant.\n(9) With the approval of the secretary, the Personnel Cabinet may place employees\nsubject to a reduction in workforce in a different position.\n(10) The secretary shall promulg ate administrative regulations pursuant to KRS Chapter\n13A to fully implement the provisions of this section.\n(11) A layoff, furlough, or reduction of hours implemented in accordance with this\nsection shall not be appealable to the Personnel Board.","path":["KRS Chapter 18A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53727","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:39Z","sha256":"85a1bbf0ed870ac218716504b48012d550f7bb6b7c0930fdeada400aa527386e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-18a.112","next":"us-ky/krs-18a.1131"},"notice":"GroundRules: Original legal text.
