{"data":{"id":"us-ky/krs-18a.125","jurisdiction":"us-ky","citation":"KRS 18A.125","heading":"Control through payroll certification.","body":"(1) No disbursing or auditing officer of the Commonwealth shall make or approve or\ntake any part in making or approving any payment for personal service to any\nperson holding a position in the classified or unclassified service unless the payroll\nvoucher or ac count of such pay bears the certification of the secretary, or of his\nauthorized agent, that the persons named therein have been appointed and employed\nin accordance with the provisions of KRS 18A.005 to 18A.200 and the rules,\nregulations, and orders there under. The secretary may for proper cause or upon\norder of the board withhold certification from an entire payroll or from any specific\nitem or items thereon. The secretary may, however, provide that certification of\npayrolls may be made once every six (6) months, and such certification shall remain\nin effect except in the case of any officer or employee whose status has changed\nafter the last certification of his payroll. In the latter case no voucher for payment of\nsalary to such employee shall be issued or payment of salary made without the\nfurther certification of the secretary.\n(2) Any citizen, including public officers, may maintain a suit to restrain a disbursing\nofficer from making any payment in contravention of any provision of KRS\n18A.005 to 18A.2 00, or of any rule, regulation or order thereunder. Any sum paid\ncontrary to any provision of KRS 18A.005 to 18A.200 or of any rule, regulation, or\norder thereunder may be recovered in an action maintained by any citizen, from any\nofficer who made, approve d, or authorized such payment or who signed or\ncountersigned a voucher, payroll check or warrant for such payment, or from the\nsureties on the official bond of any such officer. All moneys recovered in any such\naction shall be paid into the Treasury.\n(3) Any person appointed or employed in contravention of any provision of KRS\n18A.005 to 18A.200 or of any rule, regulation, or order thereunder, who performs\nservice for which he is not paid, may maintain an action against the officer or\nofficers, employee or employees, who purported so to appoint or employ him, to\nrecover the agreed pay for such services, or the reasonable value thereof if no pay\nwas agreed upon. No such officer or employee shall be reimbursed by the\nCommonwealth at any time for any sum paid t o such person on account of such\nservices.\n(4) If the secretary wrongfully withholds certification of the payroll voucher or account\nof any employee, such employee may maintain a proceeding in the Circuit Court in\nthe county in which he resides to compel t he secretary to certify such payroll\nvoucher or account.","path":["KRS Chapter 18A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1371","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:39Z","sha256":"51fa947e746e18672042bcab2509d3f035ca9e691a25ebb3841109b08b3ac575","source_id":"us-ky","stale":false,"prev":"us-ky/krs-18a.120","next":"us-ky/krs-18a.130"},"notice":"GroundRules: Original legal text.
