{"data":{"id":"us-ky/krs-18a.138","jurisdiction":"us-ky","citation":"KRS 18A.138","heading":"Affirmative action plan for state government.","body":"(1) To ensure equal employment opportunity for all Kentuckians regardless of race,\ncolor, religion, national origin, disability, sex, or age, the affirmative action plan\ndated July 1, 1984, confirmed as part of Executive Order 84 -549 continued in force\nby Exec utive Order 88 -100, and incorporated herein by reference, shall be the\nofficial affirmative action plan for Kentucky state government. Copies of the plan,\nas well as the plans developed by individual agencies pursuant to the state plan,\nshall be maintained  on file and made available for inspection in the Office of the\nSecretary of Personnel.\n(2) Every program cabinet, department, and agency of state government shall comply\nwith the provisions of the affirmative action plan.\n(3) Equal employment opportunitie s shall be an integral part of each cabinet,\ndepartment, and agency program, and any program evaluation shall include an\nassessment of equal opportunity performance.\n(4) The secretary of personnel shall be responsible for the implementation of the plan.\nIn fulfilling his duties, he shall:\n(a) Require all cabinets, departments, and agencies of state government to\ndevelop programs consistent with the plan;\n(b) Provide any technical assistance he may deem appropriate to accomplish the\npurposes of the plan;\n(c) Provide, through the Personnel Cabinet, an annual analysis to ensure that\npersons protected by antidiscrimination laws are not adversely affected by\nexamination and selection procedures;\n(d) Provide for validation of examination procedures;\n(e) Provide fo r procedures to monitor appointments and salary adjustments to\nensure that standards are uniformly applied so as to prevent salary disparity;\n(f) Report to the Governor semiannually on actions taken pursuant to the plan;\nand\n(g) Review the plan on an annual basis and recommend necessary changes in\nconsultation with the appropriate agencies.\n(5) The secretary of personnel may also:\n(a) Promulgate administrative regulations in accordance with this chapter and\nKRS Chapter 13A to implement the affirmative action plan;\n(b) Implement programs to ensure that reasonable accommodations exist for\npersons with disabilities to allow them better access to all employment\nopportunities in state government; and\n(c) Appoint an affirmative action ad visory committee to assist him in\nimplementation of the affirmative action plan.","path":["KRS Chapter 18A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1374","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:40Z","sha256":"5fbe7651fe91c85e9dd4f384895229653741954389dbb8118b6304f1d4bfd5e5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-18a.135","next":"us-ky/krs-18a.140"},"notice":"GroundRules: Original legal text.
