{"data":{"id":"us-ky/krs-18a.194","jurisdiction":"us-ky","citation":"KRS 18A.194","heading":"Living Organ Donor Leave Program.","body":"(1) As used in this section:\n(a) \"Human organ\" means any part of a human intestine, kidney, liver, lung, or\npancreas;\n(b) \"Living donor\" means a full -time employee of the executive, judicial, or\nlegislative branch of the Commonwealth of Kentucky who is absent from\nwork due to medical reas ons associated with donating a human organ or bone\nmarrow; and\n(c) 1. \"Living organ donor leave\" means a paid leave of absence provided to a\nliving donor for time off work from the donation of a human organ or\nbone marrow and the recovery time associated with the donation; and\n2. \"Living organ donor leave\" does not include any other form of paid\nleave that has been granted by the living donor's employer.\n(2) The Commonwealth of Kentucky Living Organ Donor Leave Program is created. A\nliving donor may request  to receive living organ donor leave for donating a human\norgan or bone marrow.\n(3) Before being approved to receive any amount of living organ donor leave, the living\ndonor shall submit verification of the human organ or bone marrow donation\nprocedure to his or her employer.\n(4) Once approved, a living donor shall be granted living organ donor leave in an\namount of:\n(a) Two hundred forty (240) hours for each human organ donation; and\n(b) Forty (40) hours for each bone marrow donation.\n(5) A living donor may be approved to receive living organ donor leave each time the\nliving donor donates a human organ or bone marrow.\n(6) A living donor shall not be required to use compensatory time, sick leave, or annual\nleave before being eligible to receive living organ donor leave.\n(7) While a living donor is on living organ donor leave, he or she shall be deemed a\nstate employee and shall receive the same treatment with respect to salary, wages,\nand employee benefits.\n(8) For purposes of determining seniority, pay or pay advancement, performance\nawards, and the receipt of any benefit that may be affected by a leave of absence,\nthe service of the living donor shall be considered uninterrupted by the leav e of\nabsence.\n(9) The secretary of the Personnel Cabinet shall promulgate administrative regulations\nin accordance with KRS Chapter 13A to implement the provisions of this section.","path":["KRS Chapter 18A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50417","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:40Z","sha256":"87661525f69f0ebea9e35243fde19cf69da1a33bd3bccedb8aea0313458ad2b8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-18a.190","next":"us-ky/krs-18a.195"},"notice":"GroundRules: Original legal text.
