{"data":{"id":"us-ky/krs-18a.195","jurisdiction":"us-ky","citation":"KRS 18A.195","heading":"Compensatory time -- Payment upon leaving state service.","body":"(1) A state employee who is authorized to work one (1) or more hours in excess of the\nprescribed hours of duty shall be granted compensatory leave on an hour -for-hour\nbasis. Upon the written request of an employee who is not exempt from the\nprovisions of the F ederal Fair Labor Standards Act, 29 U.S.C. sec. 201 et seq., an\nappointing authority may grant compensatory time, in lieu of overtime pay, at the\nrate of one and one -half (1.5) hours for each hour the employee is authorized to\nwork in excess of forty (40) hours in a work week. An employee who is transferred\nor otherwise changed from the jurisdiction of one agency to another shall retain his\ncompensatory leave in the receiving agency.\n(2) An employee in a position listed in KRS 18A.115(1)(d), (e), (f), (g), (h), (i), or (k)\nshall not be eligible to receive any level of block payment for compensatory leave\nhours, except as provided in subsection (3) of this section.\n(3) Any employee who leaves state service shall be paid for the balance of unused\ncompensatory time not to exceed two hundred forty (240) hours.","path":["KRS Chapter 18A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=1387","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:40Z","sha256":"33b1bd2ce146ce82dcf6068effb3b5af901e32e25c063be7081389a8151ca804","source_id":"us-ky","stale":false,"prev":"us-ky/krs-18a.194","next":"us-ky/krs-18a.196"},"notice":"GroundRules: Original legal text.
