{"data":{"id":"us-ky/krs-18a.262","jurisdiction":"us-ky","citation":"KRS 18A.262","heading":"Conflicts of interest for Kentucky Public Employees Deferred","body":"Compensation Authority employees and trustees.\n(1) No trustee or employee of the board or authority shall:\n(a) Have any interest, direct or indirect, in the gains or profits of any investment\nor any other legal, business, or financial transaction made by the board or\nauthority, except that any such trustee or employee may be a member,\nemployee, or beneficiary of the plans administered by the board or authority;\n(b) Directly or indire ctly, for himself or herself or as an agent, use the assets of\nthe plans administered by the board or authority, except to make current and\nnecessary payments authorized by the board or authority;\n(c) Become an endorser or surety or in any manner an obligo r for moneys loaned\nby or borrowed from the board or authority;\n(d) Have a contract or agreement with the board or authority, individually or\nthrough a business owned by the trustee or the employee;\n(e) Use his or her official position with the board or authority to obtain a financial\ngain or benefit or advantage for himself or herself or a family member;\n(f) Use confidential information acquired during his or her tenure with the board\nor authority to further his or her own economic interests or that of ano ther\nperson; or\n(g) Hold outside employment with, or accept compensation from, any person or\nbusiness with which he or she has involvement as part of his or her official\nposition with the board or authority. The provisions of this paragraph shall not\nprohibit a trustee from serving as an employee of an agency participating in\nthe plans.\n(2) No trustee or employee of the board or authority, who has served as a trustee or\nemployee of the board or authority on or after July 1, 2017, shall have any interest,\ndirect or indirect, in the gains or profits of any investment or any other legal,\nbusiness, or financial transaction made by the board or authority for a period of five\n(5) years following termination of his or her position, except that any such trustee or\nemployee may be a member, employee, or beneficiary of the plans administered by\nthe board or authority.\n(3) (a) No person who is serving as a member of the General Assembly or is a public\nservant as defined by KRS 11A.010(9) shall have any interest, direct or\nindirect, in the gains or profits of any investment or any other legal, business,\nor financial transaction made by the board or authority, except that any such\ntrustee or public servant may be a member, employee, or beneficiary of the\nplans administered by the board or authority.\n(b) No person who was serving as a member of the General Assembly on or after\nJuly 1, 2017, or was serving as a public servant as defined by KRS\n11A.010(9) on or after July 1, 2017, shall have any interest, direct or indirect,\nin the gains or profits of any investment or any other legal, business, or\nfinancial transaction made by the board or authority for a period of five (5)\nyears following termination of his or her position, except that any such\nmember or public servant may be  a member, employee, or beneficiary of the\nplans administered by the board or authority.","path":["KRS Chapter 18A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51241","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:40Z","sha256":"e8c5b268bc31ea18aa131a03c0164a757ec49ce2b07757cf9a6afdf47ce72eb7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-18a.260","next":"us-ky/krs-18a.265"},"notice":"GroundRules: Original legal text.
