{"data":{"id":"us-ky/krs-190.031","jurisdiction":"us-ky","citation":"KRS 190.031","heading":"Automotive mobility dealers -- License and regulation requirements.","body":"(1) Any person, prior to engaging or continuing in the business of an automotive\nmobility dealer after June 26, 2007, shall obtain an automotive mobility dealer\nlicense from the commission.\n(2) (a) An automotive mobility dealer shall be licensed and regulated by the\ncommission under the provisions of this chapter.\n(b) The commission shall, by administrative regulations promulgated under KRS\nChapter 13A, establish requirements for initial application for and renewal of\na license to be an automotive mobility deal er. The commission's regulations\nestablishing requirements for automotive mobility dealers shall include\nprovisions for automotive mobility dealers to meet reasonable and appropriate\nquality assurance requirements. These requirements may include:\n1. Appropriate training by automotive mobility dealers regarding adapted\nvehicle usage;\n2. Driver evaluation by automotive mobility dealers; and\n3. A requirement that automotive mobility dealers obtain and maintain\ninsurance in an amount to be established by the commission.\nThe commission shall have the power to promulgate any other regulations that\nare necessary to implement this section.\n(c) The commission shall immediately suspend the license of an automotive\nmobility dealer if it determines that the dealer has sold or modified a vehicle\nthat does not comply with this section or any administrative regulations\npromulgated thereunder. A dealer whose license is suspended under this\nparagraph shall be permitted to appeal the suspension in accordance with KRS\nChapter 13B.\n(3) A licensed automotive mobility dealer shall have the right to display, inventory,\nadvertise, and offer for sale any adapted vehicle.","path":["KRS Chapter 190"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=6526","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:44Z","sha256":"d192f8eaecfa0edb03421d0957ee1ca167e1b8fd41f0970afc88f470810cd9c9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-190.030","next":"us-ky/krs-190.032"},"notice":"GroundRules: Original legal text.
