{"data":{"id":"us-ky/krs-190.358","jurisdiction":"us-ky","citation":"KRS 190.358","heading":"Powers of commission.","body":"The commission is hereby empowered to:\n(1) Exercise general supervision of the administration and enforcement of KRS\n190.350 to 190.365;\n(2) Promulgate administrative regulations in accordance with KRS Chapter 13A\npertaining to the operation of automobile, vehicle, or machinery recycler, or\nmaterial recycler establishments or places of business as the commissioner may\ndeem necessary to the administration and enforcement of KRS 190.350 to 190.365;\n(3) Promulgate administrative regulations in accordance with KRS Chapter 13A with\nrespect to the suffici ency, type of material or foliage, height, density, and size of\nscreening required by KRS 190.354 to ensure the accomplishment of the purposes\nof KRS 190.350 to 190.365;\n(4) Promulgate administrative regulations in accordance with KRS Chapter 13A with\nrespect to the procedural aspects of hearings conducted in accordance with KRS\nChapter 13B, the filing of reports and orders, the issuance of licenses and other\nmatters;\n(5) Issue, after hearing, final orders abating the operation of an automobile, vehicle, or\nmachinery recycler, or material recycler establishments or places of business in\nviolation of the provisions of KRS 190.350 to 190.365, or requiring the adoption of\nremedial measures including the construction or planting of screens or the\nutilization of natural screening, extension, modification, or addition to new or\nexisting screens;\n(6) Issue, continue in effect, revoke, modify, or deny under conditions as the\ncommission may prescribe and subject to a hearing in accordance with KRS\nChapter 13B, license s for the operation of an automobile, vehicle, or machinery\nrecycler, or material recycler establishments or places of business;\n(7) Make investigations or inspections which may be deemed necessary by the\ncommission to ensure compliance with KRS 190.350 to  190.365, or with any\nadministrative regulations or orders of the commission which may be deemed\nnecessary to enable the commission to administer and enforce the provisions of\nKRS 190.350 to 190.365;\n(8) Institute in a court of competent jurisdiction proce dures, including injunctive relief,\nto compel compliance with KRS 190.350 to 190.365 and with the final orders and\nadministrative regulations issued pursuant thereto;\n(9) Enter at any reasonable time through any officer, assistant, agent, or employee in or\nupon any public or private property for the purpose of investigation and inspection\nof conditions relating to the operation of any automobile, vehicle, or machinery\nrecycler, or material recycler establishments or places of business; and\n(10) Perform any other acts as may be necessary, proper, or desirable in order to carry\nout effectively the duties and responsibilities of the commission prescribed in KRS\n190.350 to 190.365.","path":["KRS Chapter 190"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57074","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:45Z","sha256":"3a3a5cd6977f686540359fdc90e43505b620fc5dc6dec2089398f157a322a1f3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-190.356","next":"us-ky/krs-190.360"},"notice":"GroundRules: Original legal text.
