{"data":{"id":"us-ky/krs-190a.090","jurisdiction":"us-ky","citation":"KRS 190A.090","heading":"Warrantor's prohibited actions.","body":"(1) As used in this section and KRS 190A.080:\n(a) \"Products\" means new recreational vehicles or parts, accessories, or\ncomponents of new recreational vehicles; and\n(b) \"Warranted products\" means products subject to a written warranty to the\nconsumer from a specific warrantor.\n(2) A warrantor shall not do any of the following:\n(a) Fail to perform all of its warranty obligations with respect to a warranted\nproduct;\n(b) In any written notice of a factory campaign to recreational vehicle owners and\ndealers, fail to  include the expected date by which necessary parts and\nequipment, including tires and chassis or chassis parts, if required, will be\navailable to the dealer to perform the factory campaign work. The warrantor\nshall provide sufficient parts to the dealer t o perform the factory campaign\nwork. If the number of parts provided to the dealer pursuant to this paragraph\nexceeds the requirements of the dealer to perform the factory campaign work,\nthe dealer may return unused, undamaged parts to the warrantor for cr edit\nafter completion of the factory campaign;\n(c) Subject to the provisions of KRS 190A.080, fail to compensate a dealer for\nauthorized repairs of warranted products damaged during the manufacturing\nprocess or damaged while in transit to the dealer if the  warrantor selected the\ncarrier;\n(d) Fail to compensate a dealer for authorized warranty service under this section\nin accordance with the applicable schedule of compensation provided to the\ndealer pursuant to KRS 190A.080 if the warranty service is perfor med in a\ntimely and competent manner;\n(e) Intentionally misrepresent in any way to a purchaser of a warranted product\nthat any warranty concerning the manufacture, performance, or design of the\nwarranted product is made by the dealer either as a warrantor or co-warrantor;\nor\n(f) Require a dealer to make warranties to customers in any manner related to the\nmanufacture of a warranted product.","path":["KRS Chapter 190A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43556","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:45Z","sha256":"6494cf6fe689a9577457c2a6ac775df857cb02ac1dbf5b871702445d2b346f13","source_id":"us-ky","stale":false,"prev":"us-ky/krs-190a.080","next":"us-ky/krs-190a.100"},"notice":"GroundRules: Original legal text.
