{"data":{"id":"us-ky/krs-194a.065","jurisdiction":"us-ky","citation":"KRS 194A.065","heading":"Recording of data elements for centralized criminal history record","body":"information system -- Definition of front-line staff.\n(1) For the purposes of this section, \"front -line staff\" means an employee of the\nDivision of Service Regions of the Department f or Community Based Services or\nthe immediate supervisor of an employee whose professional duties include\nongoing adult or child protective services, protective services investigations or\nassessments, or regularly conducting interviews, visits, contacts, or  providing\ntransportation services or other services in the homes of family members involved\nin adult or child protective services.\n(2) The Cabinet for Health and Family Services, the Department of Juvenile Justice, the\nDepartment of Corrections, the Admin istrative Office of the Courts, and the\nDepartment of Kentucky State Police shall be responsible for the recording of those\ndata elements that are needed for the development of the centralized criminal\nhistory record information system.\n(3) The database shall at a minimum contain the information required in KRS 27A.310\nto 27A.440.\n(4) The Cabinet for Health and Family Services shall provide access to the Department\nof Kentucky State Police, the Department of Corrections, the Department of\nJuvenile Justice, and the Administrative Office of the Courts to its database.\n(5) The cabinet secretary and the secretary of the Justice and Public Safety Cabinet\nshall establish communications, policies, and procedures to enable designated\ncabinet staff of the Department for Community Based Services who are working on\na protective services investigation or an ongoing protective services case to request\na state criminal background check, and within a reasonable time frame, but no later\nthan one (1) hour after receipt of a r equest, to have the state criminal background\ncheck sent to designated cabinet staff. Designated cabinet staff may request a state\ncriminal background check at any time for a protective services investigation and\nmay use the state criminal background check to assess staff safety concerns.\n(6) The Cabinet for Health and Family Services shall prioritize the safety needs of the\nfront-line staff of the Department for Community Based Services and provide\nimprovements in accordance with this section and KRS 194A. 562, 194A.564, and\n605.170.","path":["KRS Chapter 194A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=6641","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:46Z","sha256":"687b251dc8e9fb41f492da97f66a0df8f74d9e795a61fab59df9d8620b1f4bc2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-194a.062","next":"us-ky/krs-194a.070"},"notice":"GroundRules: Original legal text.
