{"data":{"id":"us-ky/krs-194a.115","jurisdiction":"us-ky","citation":"KRS 194A.115","heading":"Statewide Independent Living Council.","body":"(1) The Statewide Independent Living Council is hereby created and attached to the\nCabinet for Health and Family Services in accordance with 42 U.S.C. sec. 3515e for\nadministrative purposes to accomplish the purposes enumerated in 29 U.S.C. sec.\n796d (Title VI I, Part A, Section 705 of the Rehabilitation Act Amendments of\n1998). Members of the council shall be appointed by the Governor from\nrecommendations submitted by the Department for Aging and Independent Living\nconsistent with the federal mandate to include  a majority of individuals with\ndisabilities representing geographical and disability diversity, as well as\nrepresentatives from identified service providers and other entities. The\ncomposition, qualifications, and terms of service of the council shall con form to the\nfederal law.\n(2) (a) Except as provided in paragraph (b) of this subsection, any vacancy occurring\nin the membership of the Statewide Independent Living Council shall be filled\nin the same manner as the original appointment. The vacancy shall n ot affect\nthe power of the remaining members of the council.\n(b) The Governor may delegate the authority to fill a vacancy to the remaining\nvoting members of the council.\n(3) Each member of the Statewide Independent Living Council may receive a per diem\nof one hundred dollars ($100), not to exceed six hundred dollars ($600) annually,\nfor each regular or special meeting attended if the member is not employed or must\nforfeit wages from other employment. Each member may have travel expenses\napproved at the est ablished state rate and expenses reimbursed at the established\nstate agency rate for services such as personal assistance, child care, and drivers for\nattendance at council meetings, and in the performance of duties authorized by the\nStatewide Independent Living Council.
