{"data":{"id":"us-ky/krs-194a.505","jurisdiction":"us-ky","citation":"KRS 194A.505","heading":"Prohibited activities -- Commencement of proceedings for enforcement.","body":"(1) No person shall, with intent to defraud, knowingly make a false statement or\nmisrepresentation or by other means fail to disclose a material fact used in\ndetermining the person's qualification to receive benefits under any assistance\nprogram.\n(2) No person  shall, with intent to defraud, fail to report a change in the factors\naffecting the person's eligibility for benefits.\n(3) No person shall, with intent to defraud, knowingly use, attempt to use, acquire,\ntransfer, forge, alter, traffic, counterfeit, or po ssess a medical identification card,\nfood stamp or food stamp identification card, or unique electronic authorization\ncodes or numbers or electronic personal identification numbers in any manner not\nauthorized by law.\n(4) No person having responsibility fo r the administration of an assistance program\nshall, having knowledge that it is in violation of the law, knowingly aid or abet any\nperson in obtaining benefits to which the person is not legally entitled, or in\nobtaining a benefit amount greater than that to which the person is fully entitled.\n(5) No person shall misappropriate or attempt to misappropriate a food stamp\nauthorization-to-purchase card, food stamp identification card, or Medicaid\nidentification card or misappropriate other benefits from any p rogram with which\nthe person has been assigned responsibility, nor shall the person knowingly fail to\nreport any of these activities when it is clearly in violation of the law.\n(6) No person shall, with intent to defraud or deceive, devise a scheme or plan  a\nscheme or artifice to obtain benefits from any assistance program by means of false\nor fraudulent representations or intentionally engage in conduct that advances the\nscheme or artifice.\n(7) No person shall aid and abet another individual in acts prohib ited in subsections (1)\nto (6) of this section knowing it to be in violation of the law.\n(8) The Attorney General on behalf of the Commonwealth of Kentucky may commence\nproceedings to enforce this section, and the Attorney General shall in undertaking\nthese proceedings exercise all powers and perform all duties that a prosecuting\nattorney would otherwise perform or exercise.","path":["KRS Chapter 194A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=6676","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:47Z","sha256":"279cd5d86376f49366dffbba93535aa93cbb5c6a305bd3ea6c3c04091cd73086","source_id":"us-ky","stale":false,"prev":"us-ky/krs-194a.500","next":"us-ky/krs-194a.510"},"notice":"GroundRules: Original legal text.
