{"data":{"id":"us-ky/krs-194a.603","jurisdiction":"us-ky","citation":"KRS 194A.603","heading":"Alzheimer's Disease and Related Disorders Advisory Council --","body":"Membership, duties, and personnel.\n(1) The Alzheimer's Disease and Related Disorders Advisory Council is created. The\ncouncil shall report directly to the office.\n(2) The council shall be composed of the following sixteen (16) members:\n(a) The secretary of the Cabinet for Health and Family Services or his or her\ndesignee;\n(b) The commissioner of the Department for Aging and Independent Living or his\nor her designee;\n(c) The commissioner of the Department for Public Health or his or her designee;\n(d) The commissioner of the Department for Medicaid Services or his or her\ndesignee;\n(e) The state long-term care ombudsman or his or her designee;\n(f) The executive director of the Area Agencies on Aging or his or her designee;\n(g) Two (2) unaffiliated individuals who are current or former unpaid caregivers\nfor individuals living with Alzheimer's disease or another dementia, appointed\nby the Governor from a list of names of qualified pe rsons submitted by any\ninterested parties;\n(h) One (1) individual who represents the residential long -term care industry,\nappointed by the Governor from a list of names of qualified persons submitted\nby any interested parties;\n(i) One (1) individual who represents providers of adult day care services,\nappointed by the Governor from a list of names of qualified persons submitted\nby any interested parties;\n(j) One (1) individual who represents the home care providers, appointed by the\nGovernor from a list of names of qualified persons submitted by any\ninterested parties;\n(k) One (1) individual employed by and representing an organization that\nadvocates solely on behalf of physicians, appointed by the Governor from a\nlist of names of qualified persons submitted by any interested parties;\n(l) One (1) individual employed by and representing an organization that\nadvocates solely on behalf of nurses, appointed by the Governor from a list of\nnames of qualified persons submitted by any interested parties;\n(m) One (1) individual who conducts research regarding Alzheimer's disease or\nother dementias, appointed by the Governor from a list of names of qualified\npersons submitted by any interested parties;\n(n) One (1) individual who represents an or ganization that advocates solely on\nbehalf of individuals living with Alzheimer's disease or other dementias,\nappointed by the Governor from a list of names of qualified persons submitted\nby any interested parties; and\n(o) One (1) individual representing a  statewide organization that advocates on\nbehalf of Kentuckians aged fifty (50) or older, appointed by the Governor\nfrom a list of names of qualified persons submitted by any interested parties.\n(3) Members who are not state employees shall be reimbursed f or necessary and actual\nexpenses.\n(4) The council shall meet at least quarterly and at other such times as it determines\nnecessary to perform its duties. A majority of the members shall constitute a\nquorum for the transaction of the council's business.\n(5) The council shall:\n(a) Elect its own chairperson and establish other officers and subcommittees as\nneeded to execute the duties of the council;\n(b) Adopt bylaws and operate under its bylaws;\n(c) By December 1, 2029, and by December 1 every four (4) years thereafter,\nsubmit an updated Kentucky Alzheimer's and Related Dementias State Plan to\nthe Legislative Research Commission for referral to the Interim Joint\nCommittee on Health Services. If the council determines that amendments\nneed to be made to the stat e plan, an amended Kentucky Alzheimer's and\nRelated Dementia State Plan may be presented to the Legislative Research\nCommission for referral to the Interim Joint Committee on Health Services;\n(d) Beginning December 1 of each year, develop and implement a y ear-long\ninitiative that advances a key area of the Kentucky Alzheimer's and Related\nDementias State Plan. The key area to be addressed each year shall be\ndetermined by a vote of the council, unless otherwise provided by law.\nCompleted initiatives may be r eviewed by the council annually. After review,\nat the discretion of the council, completed initiatives may be updated as\nnecessary; and\n(e) Serve in an advisory capacity to the Governor, the General Assembly, the\ncabinet and all other state agencies on mat ters relating to the Kentucky\nAlzheimer's and Related Dementias State Plan. The council shall review and\nmake recommendations regarding progress towards the goals of the state plan\nand on progress in implementing resources and services to serve individuals\nwith dementia and related diseases across Kentucky in the future.\n(6) Members shall serve for a term of two (2) years and may be reappointed. All\nsubsequent appointments or reappointments shall be for terms of two (2) years. If\nan appointee resigns or is otherwise unable to complete the appointed term, the\nGovernor shall appoint a new individual whose expertise or experience satisfies the\nvacated position within ninety (90) days.","path":["KRS Chapter 194A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57312","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:47Z","sha256":"78e4371f15fddd8e07208cd7dd372f7f1cfc09e32b24a9eb5978e5c4b1d91f26","source_id":"us-ky","stale":false,"prev":"us-ky/krs-194a.601","next":"us-ky/krs-194a.609"},"notice":"GroundRules: Original legal text.
