{"data":{"id":"us-ky/krs-194a.705","jurisdiction":"us-ky","citation":"KRS 194A.705","heading":"Services provided to assisted living community residents -- Required","body":"services -- Access to basic health and health -related services -- Written policies\nto be given to resident -- Functional needs assessment.\n(1) The assisted living commu nity shall provide each resident with access to the\nfollowing services according to the lease agreement:\n(a) Assistance with activities of daily living and instrumental activities of daily\nliving;\n(b) Three (3) meals and snacks made available each day, wit h flexibility in a\nsecured dementia care unit to meet the needs of residents with cognitive\nimpairments who may eat outside of scheduled dining hours;\n(c) Scheduled daily social activities that address the general preferences of\nresidents;\n(d) Assistance with self-administration of medication; and\n(e) Housing.\n(2) (a) The assisted living community may provide residents with access to basic\nhealth and health-related services.\n(b) If an assisted living community chooses to provide basic health and health -\nrelated services, the assisted living community shall supervise the residents.\n(c) Notwithstanding KRS 194A.700(4)(e), in an assisted living community or\nnursing home as defined in KRS 205.510 and licensed under KRS Chapter\n216B that provides basic health and health -related services or dementia care\nservices, a certified medication aide or an unlicensed staff person who has\nsuccessfully completed a medication aide training and skills competency\nevaluation program approved by the Kentucky Board of Nursing may\nadminister oral or topical medication, or preloaded injectable insulin to a\nresident under the authority of an available licensed practical nurse, registered\nnurse, or advanced practice registered nurse.\n(d) Unlicensed personnel who administer oral or topical medications to residents\nof an apartment -style personal care home required by  KRS 194A.704 to\nconvert to a licensed assisted living community shall comply with the\nmedication aide requirements of paragraph (c) of this subsection no later than\nsix (6) months from June 29, 2023.\n(3) (a) Residents of an assisted living community may arrange for additional services\nunder direct contract or arrangement with an outside agent, professional,\nprovider, or other individual designated by the resident if permitted by the\npolicies of the assisted living community.\n(b) Permitted services for whic h a resident may arrange or contract include but\nare not limited to health services, hospice services provided by a hospice\nprogram licensed under KRS Chapter 216B, and other end-of-life services.\n(4) Upon entering into a lease agreement, an assisted living community shall inform the\nresident in writing about policies relating to the provision of services by the assisted\nliving community and the contracting or arranging for additional services.\n(5) A resident issued a move -out notice shall receive the notic e in writing and the\nassisted living community shall assist each resident upon a move -out notice to find\nappropriate living arrangements. Each assisted living community shall share\ninformation provided from the cabinet regarding options for alternative liv ing\narrangements at the time a move-out notice is given to the resident.\n(6) An assisted living community shall complete and provide to the resident:\n(a) Upon move -in, a copy of a functional needs assessment pertaining to the\nresident's ability to perform activities of daily living and instrumental\nactivities of daily living and any other topics the assisted living community\ndetermines to be necessary; and\n(b) After move-in, a copy of an updated functional needs assessment pertaining to\nthe resident's abili ty to perform activities of daily living and instrumental\nactivities of daily living, the service plan designed to meet identified needs,\nand any other topics the assisted living community determines to be\nnecessary.","path":["KRS Chapter 194A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54873","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:47Z","sha256":"ee11423565bb529be4999c7e8dddbb03730e1eb7147eed923f508e2ca73fc70b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-194a.704","next":"us-ky/krs-194a.7052"},"notice":"GroundRules: Original legal text.
