{"data":{"id":"us-ky/krs-194a.7061","jurisdiction":"us-ky","citation":"KRS 194A.7061","heading":"Assisted living community with dementia care licensure criteria --","body":"Exception -- Inspections.\n(1) An applicant for licensure as an assisted living community with dementia care shall\nhave the ability to provide services in a manner that is co nsistent with the\nrequirements in this section. The cabinet shall consider the following criteria for\nlicensure, including but not limited to:\n(a) The education and experience of the applicant or its principals in managing\nresidents with dementia or other dementia illnesses and disorders; and\n(b) The compliance history of the applicant in the operation of any care facility\nlicensed, certified, or registered under federal or state law.\n(2) If the applicant or its principals do not have experience in managing  residents with\ndementia, the applicant shall employ or contract with a consultant pursuant to terms\ndetermined by the applicant and consultant for at least the first six (6) months of\noperation. The consultant shall make recommendations on providing demen tia care\nservices consistent with the requirements of this chapter. The consultant shall:\n(a) Possess two (2) years of work experience related to dementia, health care,\ngerontology, or an associated field; and\n(b) Have completed at least the core training required by KRS 194A.7205.\n(3) The applicant shall document an acceptable plan to address the consultant's\nidentified concerns and shall either implement the recommendations or document in\nthe plan any consultant recommendations that the applicant chooses not to\nimplement. The cabinet shall review the applicant's plan upon request.\n(4) Subsections (1), (2), and (3) of this section apply only to the initial licensure of\nassisted living communities with dementia care and do not apply to existing\ndementia units in operation as of July 14, 2022.\n(5) The cabinet shall conduct an on -site inspection prior to the issuance of an assisted\nliving community with dementia care license. An on -site inspection of an existing\nsecured dementia care unit licensed as part of a certified assisted living community\nor a licensed personal care home that is conducted prior to the initial issuance of an\nassisted living community with dementia care license shall be for the purpose of\nensuring compliance with the physical environment requirements.\n(6) The license shall be inscribed as an \"Assisted Living Community with Dementia\nCare.\"","path":["KRS Chapter 194A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52515","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:47Z","sha256":"ff948c2f680b91f878a3214ccd468537f21dc5d31d51d7953032182dcbf9fe7d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-194a.7052","next":"us-ky/krs-194a.7063"},"notice":"GroundRules: Original legal text.
