{"data":{"id":"us-ky/krs-194a.7063","jurisdiction":"us-ky","citation":"KRS 194A.7063","heading":"Voluntary relinquishment of license -- Obligations.","body":"A licensee shall notify the cabinet in writing at least sixty (60) calendar days prior to the\nvoluntary relinquishment of an assisted living community with dementia care license. For\nvoluntary relinquishment, the facility shall:\n(1) Give all residents and their designated and legal representatives sixty (60) calendar\ndays' notice. The notice shall include:\n(a) The proposed effective date of the relinquishment;\n(b) Changes in staffing;\n(c) Changes in services, including the elimination or addition of services; and\n(d) Changes in staff training when the relinquishment becomes effective;\n(2) Submit a transitional plan to the cabinet demonstrating how the current residents\nshall be evaluated and assessed to reside in other housing settings that are not an\nassisted living community with dementia care, that are physically unsecured, or that\nwould require move-out or transfer to other settings;\n(3) Change service or care plans as appropriate to address any needs the residents may\nhave with the transition;\n(4) Notify the cabinet when the relinquishment process has been completed; and\n(5) Revise advertising materials and disclosure information to remove any reference\nthat the facility is an assisted living community with dementia care.","path":["KRS Chapter 194A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52516","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:47Z","sha256":"20de97700e7fbe169ee6427d6c552d1a62347bebaf96722944f0b1b11d6c06c2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-194a.7061","next":"us-ky/krs-194a.7065"},"notice":"GroundRules: Original legal text.
