Acts ch.","body":"158 -- Deposit in criminal justice reinvestment fund.\n(1) As used in this section:\n(a) \"Cost savings\" means  the ending balance excluding any necessary\ngovernment expenses as identified in an enacted appropriations bill and\nany agency transfers that occurred in the same fiscal year from which an\nending balance is realized;\n(b) \"Criminal justice reinvestment fund\" means  the fund established in KRS\n196.042; and\n(c) \"Ending balance\" means the remaining general fund moneys unexpended\nfor the fiscal year in which those funds were appropriated by the General\nAssembly.\n(2) Beginning with the close of fiscal year 2017-2018 and each fiscal year\nthereafter, the department shall measure and document cost savings based on\nan ending balance created as a result of 2017 Ky. Acts ch. 158. Calculations\nshall be  based  on  the department's overall general fund appropriation.\nMeasured  and documented cost savings shall be reinvested and appropriated\nas provided in KRS 196.042.\n(3) (a) Notwithstanding KRS  45.229, any cost savings calculated pursuant to\nsubsection (2) of this section shall not lapse but shall be deposited by the\ndepartment into the criminal justice reinvestment fund.\n(b) If no cost savings are calculated pursuant to subsection (2) of this\nsection, no funds shall be deposited into the criminal justice reinvestment\nfund.","path":["KRS Chapter 196"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46854","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:48Z","sha256":"f84461704309ffeb2515ce43a5fd0397d6fd6979bf75653fade6c0c59efdd731","source_id":"us-ky","stale":false,"prev":"us-ky/krs-196.042","next":"us-ky/krs-196.045"},"notice":"GroundRules: Original legal text.
