{"data":{"id":"us-ky/krs-196.045","jurisdiction":"us-ky","citation":"KRS 196.045","heading":"Administrative regulations for restoration of civil rights to eligible felony","body":"offenders.\n(1) The Department of Corrections shall promulgate administrative regulations in\naccordance with KRS Chapter 13A to implement a simplified process for the\nrestoration of civil rights to eligible felony offenders. As part of this simplified\nprocess, the Department of Corrections shall:\n(a) Inform eligible offenders about the process for restoration of civil rights and\nprovide a standard form which individuals may si gn upon their release to\nformally request that the Department of Corrections initiate the process;\n(b) Generate a list on a monthly basis of eligible offenders who have been\nreleased by the Department of Corrections or discharged by the Parole Board\nand who have requested that their civil rights be restored;\n(c) Conduct an investigation and compile the necessary information to ensure that\nall restitution has been paid and that there are no outstanding warrants,\ncharges, or indictments;\n(d) Provide notice to  the Commonwealth's attorney in the county of commitment\nand to the Commonwealth's attorney in the offender's county of residence,\nsetting out in the notification the criminal case number and charges for which\nthe offender was convicted; and\n(e) Forward information on a monthly basis of eligible felony offenders who have\nrequested restoration of rights to the Office of the Governor for consideration\nof a partial pardon.\n(2) As used in this section, \"eligible felony offender\" means a person convicted of one\n(1) or more felonies who:\n(a) Has reached the maximum expiration of his or her sentence or has received\nfinal discharge from the Parole Board;\n(b) Does not have any pending warrants, charges, or indictments; and\n(c) Had paid full restitution as ordered by the court or the Parole Board.\n(3) As used in this section, \"civil rights\" means the ability to vote, serve on a jury,\nobtain a professional or vocational license, and hold an elective office. It does not\ninclude the right to bear arms.\n(4) Any eligible of fender not provided for under subsection (2) of this section may\nsubmit an application directly to the Department of Corrections to initiate the\nprocess outlined in subsection (1) of this section.","path":["KRS Chapter 196"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=6784","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:48Z","sha256":"14316c43e61fd563fd369dca97869737eae0a75a57d7d0b0ee5788589d52ba6d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-196.044","next":"us-ky/krs-196.050"},"notice":"GroundRules: Original legal text.
