{"data":{"id":"us-ky/krs-196.111","jurisdiction":"us-ky","citation":"KRS 196.111","heading":"Evidence -based practices to be used in treatment and intervention","body":"programs -- Standards -- Funding restrictions.\n(1) As used in this section, \"evidence -based practices\" means supervision policies,\nprocedures, treatment and intervention programs, and  practices that scientific\nresearch demonstrates reduce recidivism among inmates and individuals on\nprobation, parole, or other form of post -release supervision when implemented\ncompetently.\n(2) In order to increase the effectiveness of treatment and intervention programs funded\nby the state and provided by the department for inmates, probationers, and parolees,\nthe department shall require that such programs use evidence-based practices.\n(3) The department shall measure the effectiveness of each treatment and intervention\nprogram and demonstrate that the program has a documented evidence base and has\nbeen evaluated for effectiveness in reducing recidivism.\n(4) The department shall promulgate administrative regulations to provide, at a\nminimum:\n(a) A process  for reviewing the objective criteria for evidence -based practices\nestablished by the agency providing the program;\n(b) A process for auditing the effectiveness of the program;\n(c) An opportunity for programs that do not meet the criteria based on the audi t\nresults to improve performance; and\n(d) A mechanism to defund any program that does not meet the criteria upon a\nsecond audit.\n(5) Beginning July 1, 2012, twenty -five percent (25%) of state moneys expended on\nprograms shall be for programs that are in ac cordance with evidence -based\npractices. Beginning July 1, 2014, fifty percent (50%) of state moneys expended on\nprograms shall be for programs that are in accordance with evidence -based\npractices. Beginning July 1, 2016, and thereafter, seventy -five percen t (75%) of\nstate moneys expended on programs shall be for programs that are in accordance\nwith evidence-based practices.\n(6) By fiscal year 2016 -2017, the department shall eliminate supervision policies,\nprocedures, programs, and practices intended to redu ce recidivism that scientific\nresearch demonstrates do not reduce recidivism. However, the department may\nutilize a new supervision policy, procedure, program, or practice if the department\ndetermines that the new supervision policy, procedure, program, or  practice has the\npotential for qualifying as an evidence -based practice after more scientific research\nis conducted.","path":["KRS Chapter 196"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40922","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:48Z","sha256":"06051d83d1bed14c30be2b62e35114ae2d4efca85be20baef470a655e04f02fd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-196.110","next":"us-ky/krs-196.120"},"notice":"GroundRules: Original legal text.
