{"data":{"id":"us-ky/krs-196.167","jurisdiction":"us-ky","citation":"KRS 196.167","heading":"Transfer of employees, property, and records associated with inmate","body":"education from the Kentucky Community and Technical College System to the\ndepartment -- Employee benefits.\n(1) Effective July 1, 2010, faculty and staff of the Kentucky Community and Technical\nCollege System who:\n(a) Are engaged in providing educational services and support to inmates at\ninstitutions; and\n(b) Exercise the option in subsection (4) of this section;\nshall be transferred to the Department of Corrections along with the fun ding\nassociated with those employees. The Personnel Cabinet shall assist the department\nin implementing the transfer of employees according to this section.\n(2) Employees transferred pursuant to subsection (1) of this section shall retain:\n(a) Their salaries and leave time balances accumulated as of the transfer date;\n(b) For purposes of determining leave time accumulation, the date of initial\nemployment with a state agency or a postsecondary educational institution,\nwhichever is earlier; and\n(c) For purpos es of calculating retirement and retiree health benefits and\ncontributions, the earlier of the date of initial participation in:\n1. A state-administered retirement system if the employee has participated\nor is participating in the Kentucky Employees Retire ment System or the\nKentucky Teachers' Retirement System; or\n2. A defined contribution plan that meets requirements of 26 U.S.C. sec.\n403(b), for employees of the Kentucky Community and Technical\nCollege System.\nNothing in this paragraph shall be construed  to provide additional service\ncredit for the employee prior to the transfer date other than what has been\ncredited to the appropriate retirement system.\n(3) Employees exercising their option under subsection (4) of this section may elect to\nbe covered under KRS Chapter 18A and receive:\n(a) All rights and benefits provided to other employees in the department; and\n(b) Their choice of retirement benefits under:\n1. The Kentucky Teachers' Retirement System; or\n2. Hazardous duty retirement benefits under the Kentucky Employees\nRetirement System with hazardous duty contributions and coverage\nbeginning July 1, 2010. The hazardous duty retirement benefits shall be\ncalculated in accordance with KRS 61.510 to 61.705.\n(4) Employees of the Kentucky Community and Technical College System engaged in\nproviding educational services and support to inmates at institutions shall choose\nwhether to remain in their present employment and be assigned to the department to\ncontinue providing these services, or become an employee of the department under\nthe terms of this section. Employees shall make their choice on or before June 15,\n2010, and shall have access to counseling prior to June 15, 2010, by representatives\nof the department, t he Kentucky Community and Technical College System,\napplicable retirement systems, and the Personnel Cabinet concerning the effect that\nchoosing employment with the department would have on the employee. If an\nemployee does not make a choice on or before J une 15, 2010, that employee shall\nbe deemed to have chosen to exercise the option to become an employee of the\ndepartment with retirement benefits described in subsection (3)(b)2. of this section.\n(5) Effective July 1, 2010, all instructional supplies, equ ipment, funds, and records of\nthe Kentucky Community and Technical College System associated with the\nprovision of educational services and support to inmates at institutions shall be\ntransferred to the department along with all financial and management ov ersight\nresponsibility and liability for these programs.","path":["KRS Chapter 196"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=6807","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:49Z","sha256":"a489b093778f07bae03ddc9df1000d45dbfd784855e52a6e25319bcce41f22e9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-196.165","next":"us-ky/krs-196.170"},"notice":"GroundRules: Original legal text.
