{"data":{"id":"us-ky/krs-196.732","jurisdiction":"us-ky","citation":"KRS 196.732","heading":"Community corrections funds -- Deposit of state funds saved via pilot","body":"projects -- Purposes of appropriated funds.\n(1) Beginning in the fiscal year after a pilot project has been implemented pursuant to\nKRS 196.731, fifty percent (50%) of any state exp enditures that are avoided as\ncalculated in KRS 196.731 shall be deposited by the department in the community\ncorrections fund, which shall be a separate, interest-bearing account within the State\nTreasury. The remaining fifty percent (50%) shall be deposi ted in the general fund.\nAmounts deposited in the community corrections fund, including interest, are\nhereby appropriated to the commission for the following purposes:\n(a) Fifty percent (50%) to the community corrections program responsible for\nthose savings; and\n(b) Fifty percent (50%) to the Division of Probation and Parole.\n(2) Notwithstanding KRS 45.229, any moneys remaining in the community corrections\nfund at the close of the fiscal year shall not lapse but shall carry forward into the\nnext fiscal year to be used for the purposes outlined in this subsection.\n(3) None of the calculated savings shall be appropriated to the commission for\ndistribution if:\n(a) In a pilot project developed pursuant to KRS 196.731(1)(a), there is an\nincrease in the percentag e of targeted offenders on probation who are\nconvicted of a new felony offense and sentenced to a term of imprisonment; or\n(b) In a pilot project developed pursuant to KRS 196.731(1)(b), there is an\nincrease in the percentage of supervised individuals who are convicted of a\nnew felony offense.\n(4) The moneys appropriated pursuant to this section shall be used to supplement, not\nsupplant, any other state or county appropriations for probation, parole or other\npost-prison supervision services, or community corrections programs.\n(5) Moneys received through appropriations pursuant to this section and KRS 196.731\nshall be used for the following purposes:\n(a) Implementing evidence-based practices;\n(b) Creating, increasing, or improving the availability of risk red uction and\ntreatment programs and interventions, including substance abuse treatment\nprograms, for supervised individuals;\n(c) Paying the costs of global positioning monitoring system for offenders of at\nleast medium risk; and\n(d) Increasing the number of probation and parole staff, including equipment and\noffice space the officers and staff may need.","path":["KRS Chapter 196"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39587","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:49Z","sha256":"f5254e2bb49a60b551b12771f8c009047c67cb2b8f9bdc64722c0c7e34c45fae","source_id":"us-ky","stale":false,"prev":"us-ky/krs-196.731","next":"us-ky/krs-196.735"},"notice":"GroundRules: Original legal text.
