{"data":{"id":"us-ky/krs-197.022","jurisdiction":"us-ky","citation":"KRS 197.022","heading":"Personal attendance of state prisoner in civil action -- Transportation","body":"orders -- Payment of costs -- Participation of prisoner in action by alternative\nmethods allowed.\n(1) Whenever a court finds the personal attendance of a state prisoner is necessa ry in a\ncivil action and orders the Justice and Public Safety Cabinet or its agent or any law\nenforcement officer to transport a prisoner in connection with the civil action, the\nparty requesting that the state prisoner be transported to the hearing shall pay the\ntransportation cost, which shall include the estimated round trip cost, including the\nstate mileage rate and the estimated associated salary cost of correctional staff.\n(2) The court shall cause all transportation orders to be delivered to the ward en or jailer\nof the detention facility where the prisoner resides. As soon as practicable after the\nreceipt of the order, the warden or jailer shall notify the prisoner and the court of the\ntotal transportation cost. If the payment is not received twenty -four (24) hours in\nadvance of the scheduled hearing, no transportation shall be provided, irrespective\nof the order of the court commanding the Justice and Public Safety Cabinet or its\nagent or other law enforcement officer to transport a prisoner.\n(3) To the extent practicable, any action concerning a prisoner in which the court has\ndetermined that the prisoner's participation is required or permitted may be\nconducted by telephone, video conference, or other telecommunications technology\nwithout removing the prisoner from the facility in which the prisoner is confined.\n(4) The provisions of this section pertaining to payment of transportation costs shall not\napply to parties who have been determined by the court to be indigent within the\nmeaning of KRS Chapter 31 or other applicable law.\n(5) The Justice and Public Safety Cabinet shall promulgate an administrative regulation\nor regulations governing this process.","path":["KRS Chapter 197"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=6860","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:49Z","sha256":"95ae5753cd14875f45b8f1848c0ed25c87694a6ceb59e860d75273e673a9e348","source_id":"us-ky","stale":false,"prev":"us-ky/krs-197.020","next":"us-ky/krs-197.023"},"notice":"GroundRules: Original legal text.
