{"data":{"id":"us-ky/krs-197.420","jurisdiction":"us-ky","citation":"KRS 197.420","heading":"Department of Corrections to administer program -- Treatment in","body":"inpatient and outpatient environments -- Transfer -- Staff -- Data collection.\n(1) The department shall have the sole authority and responsibility for establishing by\nregulation the desig n of the specialized program created in KRS 197.400 to\n197.440.\n(2) The program shall include diagnostic and treatment services in both inpatient and\noutpatient environments:\n(a) \"Diagnostic services\" shall include social and family histories, medical\nhistory, educational development, interpersonal development, criminal\nhistory, psychological screening, and pre-release evaluation;\n(b) \"Treatment services\" shall include individualized treatment plans to include\nindividual, group, marital, and family counseli ng; psychoeducational courses\nto include sex education and victim personalization; and social skills\ndevelopment to include assertiveness training, stress management, and\naggression management; and\n(c) The department shall have the authority and responsibi lity for establishing\nother educational and work programs necessary to complement treatment\nprogram objectives.\n(3) The department may transfer sexual offenders sentenced to its custody to the\nprogram and shall adopt administrative regulations concerning the transfer of sexual\noffenders.\n(4) All sexual offenders participating in the program may be housed separately from all\nother incarcerated inmates but shall be housed in accordance with the department's\nstandard classification system.\n(5) The treatment staff of the program shall minimumly consist of the following staff:\n(a) A program director who has at least a master's degree in a recognized mental\nhealth field and six (6) years' clinical experience or a doctoral degree in a\nrecognized mental health field  and four (4) years' clinical experience. The\ndirector shall decide program policies and supervise all staff;\n(b) A clinical psychologist or a master's degree level psychologist for each two\nhundred (200) participants. At least one (1) clinical psychologis t shall be a\nmember of the staff at all times; and\n(c) A counselor for each fifty (50) participants.\n(6) The department shall establish a system of data collection and program evaluation\nso as to allow study of participating sexual offenders and their offe nses and to\nmeasure the impact of the program on recidivism.","path":["KRS Chapter 197"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=6899","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:50Z","sha256":"0e2a95a40ee519042ea9c4a3625bce51462fd199b1460da00f520aaeec907c11","source_id":"us-ky","stale":false,"prev":"us-ky/krs-197.410","next":"us-ky/krs-197.430"},"notice":"GroundRules: Original legal text.
