{"data":{"id":"us-ky/krs-197.530","jurisdiction":"us-ky","citation":"KRS 197.530","heading":"Assessment of fine or penalty against private provider -- Notice -- Hearing","body":"-- Appeal.\n(1) As set forth within the contract between the Department of Corrections and the\nprivate provider: The department may recommend to the secretary of the Finance\nand Administration Cabinet the assessment of an administrative fine against the\nprivate provider of not more than five thousand dollars ($5,000) for the violation of\neach and any term of the contract, or of KRS 197.510. Recommendation of fine or\npenalty assessment by the department shall occur only after a notice of intent to do\nso has been presented by registered mail to the private provider. The notice of intent\nshall incorporate the findings of the department and other agencies, if appropriate.\n(2) The private provider may, within seventy-two (72) hours of the receipt of the notice\nof intent, request in writing a hearing before an objective hearing officer of the\nAttorney General's Office. The secretary of the Finance and Administration Cabinet\nshall by ord er issue, modify, or repeal the recommended fine or penalty. The\namount of any fine or penalty shall be consistent with the hearing officer's\nrecommendations resulting from the administrative hearing. The private provider\nmay, at its discretion, waive its right to an administrative hearing.\n(3) Appeals from any fine or penalty assessed pursuant to this section shall be granted\nas a matter of right, and shall be taken to the Franklin Circuit Court within thirty\n(30) days from the date the fine or penalty is issued by the secretary of the Finance\nand Administration Cabinet.","path":["KRS Chapter 197"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=6908","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:50Z","sha256":"e1d35550d9184c63f0964247491ec7c3250ad2f6b5509b4649d590f97c2b1617","source_id":"us-ky","stale":false,"prev":"us-ky/krs-197.525","next":"us-ky/krs-197.535"},"notice":"GroundRules: Original legal text.
