{"data":{"id":"us-ky/krs-198b.040","jurisdiction":"us-ky","citation":"KRS 198B.040","heading":"General powers and duties of the department.","body":"The department shall have the following general powers and duties:\n(1) To  conduct or cause to be conducted studies to determine the needs of the\nbuilding industry of Kentucky;\n(2) To conduct or cause to be conducted or participate in studies of the costs of\nthe various factors of building construction and use of buildings and to\nrecommend  programs and procedures which will minimize the cost of buildings,\nincluding the use of energy, while maintaining safety, durability, and comfort;\n(3) To administer regulatory legislation relating to buildings and construction;\n(4) To assume administrative coordination of the various state construction review\nprograms and to cooperate with various federal, state, and local agencies in\nthe programs as they relate to buildings and construction;\n(5) To assume administration and coordination of various state housing programs\nto include:\n(a) Devising  and  implementing procedures, in conjunction with the\nDepartment  for Local Government, for attaining and maintaining an\naccurate count of the housing inventory in Kentucky, including information\non  the age, physical condition, size, facilities, and amenities of this\nhousing, and housing constructed and demolished each year;\n(b) Designing programs  coordinating the elements of housing finance,\nproduction, maintenance, and rehabilitation for the purpose of assuring\nthe availability of safe, adequate housing in a healthful environment for all\nKentucky citizens;\n(c) Establishing or causing to be  established public information and\neducational programs relating to housing, to include informing Kentucky\ncitizens about housing and housing related programs that are available on\nall levels of government;\n(d) Designing  and  administering, or participating in the design and\nadministration of educational programs to prepare low income families for\nhome  ownership, and  counseling them  during their early years as\nhomeowners;\n(e) Promoting educational programs to assist sponsors in the development\nand management  of low and moderate income housing for sale or rental;\n(f) Cooperating with various federal, state, and local agencies in their\nprograms as they relate to housing; and\n(g) Conducting or causing to be conducted studies to determine the housing\npreferences of Kentucky citizens and the present and future housing\nrequirements of the state;\n(6) To  recommend  state building industry policies and goals to the Kentucky\nGeneral Assembly;\n(7) To adopt and promulgate a mandatory uniform state building code, and parts\nthereof, which shall establish standards for the construction of all buildings, as\ndefined in KRS 198B.010, in the state;\n(8) To promulgate administrative regulations providing for the proper construction\nof public water purification plants, other than the water treatment equipment\nand systems in those plants. Any administrative regulation promulgated under\nthis subsection shall require that applications for permits to build public water\npurification plants be  submitted by the department to the Energy  and\nEnvironment  Cabinet  for  that cabinet's comments.  Any  submitted\nadministrative regulations shall require the Energy and Environment Cabinet's\ncomments  to be completed and returned to the department within sixty (60)\ndays;\n(9) To promulgate administrative regulations providing for the proper construction\nof sewage treatment plants, other than the sewage treatment equipment and\nsystems in such plants. Any administrative regulation promulgated under this\nsubsection shall require that applications for permits to build public sewage\ntreatment plants be  submitted by  the department to the Energy  and\nEnvironment  Cabinet  for  that cabinet's comments.  Any  submitted\nadministrative regulations shall require the Energy and Environment Cabinet's\ncomments  to be completed and returned to the department within sixty (60)\ndays; and\n(10) To promulgate administrative regulations for the safe installation and operation\nof plumbing and plumbing fixtures.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46899","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:51Z","sha256":"9a8e81901d0fc983b8bac2c57848a7ad9f77fe24d2808e2a1261ecd31e71ae9f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.035","next":"us-ky/krs-198b.050"},"notice":"GroundRules: Original legal text.
