{"data":{"id":"us-ky/krs-198b.050","jurisdiction":"us-ky","citation":"KRS 198B.050","heading":"Uniform State Building Code.","body":"(1) The department shall adopt and promulgate a mandatory Uniform State Building\nCode that establishes standards for the construction of all buildings, as defined in\nKRS 198B.010, in the state. The code shall provide that the review and approval, as\nnecessary, of building plans for conformance with the Uniform State Building Code\nprior to construction approval shall be conducted only by the department or a local\ngovernment or governments delegated such responsibilities by this chapter, and any\nexceptions to this policy shall be explicitly stated in the code.\n(2) The code shall be comprehensive and shall include but not be limited to provisions\nfor general construction; structural quality; mechanical systems to include heating,\ncooling, and ventilation; electrica l systems; and life safety from hazards of fire,\nexplosion, and other disasters, whether caused by acts of nature or man. The code\nshall encompass the Kentucky State Plumbing Code promulgated pursuant to KRS\n318.130, boiler rules and regulations issued pur suant to KRS 236.030, and the\nnational electrical code.\n(3) This code shall be designed after and may be selected from the models offered by\nsuch model code agencies as the International Code Council, Inc., the National Fire\nProtection Association, and oth er nationally recognized organizations which may\ninclude governmental agencies. The code shall:\n(a) Provide uniform standards and requirements for construction and construction\nmaterials;\n(b) To the extent practicable, set forth standards, specifications, and requirements\nin terms of performance objectives, so as to facilitate the use of new\ntechnologies, techniques, and materials. The code shall not discriminate in\nfavor of particular suppliers' materials, techniques, or technologies; and\n(c) Protect the public health, safety, and welfare within the state.\n(4) The code shall include provisions for the continuing review and possible adoption\nof new materials, technologies, and techniques in the building industry when\ndeemed justified by the department to ful fill the purposes of this chapter. The\ndepartment may adopt a model code promulgated by a model code agency only if\nthat agency provides a method for democratic participation by the department and\nany local governments which may enforce the code, in a cont inuing review and\npossible adoption of new materials, technologies, and techniques in the building\nindustry.\n(5) The department shall promulgate administrative regulations, after notice in\naccordance with KRS Chapter 13A, which are necessary to implement t he Uniform\nState Building Code or to carry out any other responsibility assigned to the\ndepartment by this chapter.\n(6) The department shall monitor the effectiveness of agencies designated by local\ngovernments to enforce the provisions of the Uniform State Building Code.\n(7) If the department determines that an agency is not enforcing the provisions of the\nUniform State Building Code, it shall determine where deficiencies exist. The\ndepartment shall require the local government to correct the deficiencies within\nsixty (60) days and report to the department its method of correcting the\ndeficiencies.\n(8) If the local government fails to correct the deficiencies, the department may preempt\nthe local program as provided for in KRS 198B.060(4).\n(9) The department shall provide for the supply, including amendments and revisions\nthereto, of sufficient copies of the Uniform State Building Code for all interested\nparties.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46900","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:51Z","sha256":"4c5af65d61585a95cbf9c9e0da96ee27a4144f9c99dec07e29c9e50b88644f04","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.040","next":"us-ky/krs-198b.055"},"notice":"GroundRules: Original legal text.
