{"data":{"id":"us-ky/krs-198b.130","jurisdiction":"us-ky","citation":"KRS 198B.130","heading":"Private action for damages -- Time limitation.","body":"(1) Notwithstanding any other remedies available, any person or party, in an individual\ncapacity or on behalf of a class of persons or parties, damaged as a result of a\nviolation of this chapter or the Uniform State Building Code, has a cause of action\nin any court of competent jurisdiction against the person or party who committed\nthe violation. An award may include damages and the cost of litigation. If a\ncertificate of occupancy was not issued, then an award may also include reasonable\nattorney's fees.\n(2) Any action based upon a claim of violation of this section shall be brought within\none (1) year of the date on which the damage is discovered or in the exercise of\nreasonable diligence could have been discovered. However, in no event shall an\naction be brou ght under this section more than ten (10) years after the date of first\noccupation or settlement date, whichever is sooner.\n(3) Nothing in this section shall be construed to bar any common law liability of a\ncontractor or subcontractor or any right or caus e of action against any contractor or\nsubcontractor created by any other statute.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50219","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:51Z","sha256":"0c5550891bbed98e39692a93bf823c6ef5c7bd9e84de178e21d8b517ca544c68","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.120","next":"us-ky/krs-198b.135"},"notice":"GroundRules: Original legal text.
