{"data":{"id":"us-ky/krs-198b.400","jurisdiction":"us-ky","citation":"KRS 198B.400","heading":"Definitions for KRS  198B.400 to 198B.540.","body":"As used in KRS 198B.400 to 198B.540, unless the context otherwise requires:\n(1) \"Elevator\" means  all the machinery, construction, apparatus, and equipment\nused  in raising and lowering a car, cage, or platform vertically between\npermanent  rails or guides, and includes all elevators, power dumbwaiters,\nescalators, gravity elevators, and  other lifting or  lowering apparatus\npermanently installed between rails or guides, but does not include hand\noperated dumbwaiters, manlifts of the platform type with a platform area not\nexceeding nine hundred square inches, construction hoists, or other similar\ntemporary lifting or lowering apparatus;\n(2) \"Passenger elevator\" means an elevator that is designed to carry persons to its\ncontract capacity;\n(3) \"Freight elevator\" means  an elevator used for carrying freight and on which\nonly the operator, by the permission of the employer, is allowed to ride;\n(4) \"General inspector\" means  a state inspector examined and hired to inspect\nelevators for the department;\n(5) \"Special inspector\" means  an  inspector examined  and  certified by the\ndepartment to inspect elevators in the state;\n(6) \"Inspector\" means either a general or special inspector;\n(7) \"Department\" means the Department of Housing, Buildings and Construction;\n(8) \"Certificate of operation\" means  a certificate issued by the department\nauthorizing the operation of an elevator which shall be conspicuously posted\non the elevator at all times;\n(9) \"Escalator\" means  a moving stairway consisting of steps attached to a\ncontinuously circulating belt that is used to move persons from one (1) level to\nanother;\n(10) \"Moving sidewalk\" means  horizontal flat panels attached to a continuously\ncirculating belt used to move people;\n(11) \"Fixed guideway system\" means  any nonrail system, funicular, or automated\npeople mover, either air-suspended or wheeled, that is not regulated by the\nFederal Transit Administration;\n(12) \"Mine elevator\" means  an elevator permanently installed in a mine shaft to\nprovide vertical transportation of mine personnel, their tools, equipment, and\nmine supplies;\n(13) \"Stage elevator\" means a section of a stage arranged to be raised and lowered\nabove and below the stage in a vertical direction;\n(14) \"Orchestra elevator\" means a platform used for raising and lowering musicians\nin an orchestra in a vertical direction;\n(15) \"Organ console elevator\" means a mechanism used for raising and lowering an\norgan console, including the organist, in a vertical direction;\n(16) \"Material lift\" means  a hoisting and lowering mechanism  equipped with a car\nthat moves within a guide system installed at an angle of greater than seventy\n(70) degrees from the horizontal, serving two (2) or more landings, for the\npurpose of transporting materials that are manually or automatically loaded or\nunloaded. A person shall not ride on a material lift;\n(17) \"Elevator contractor\" means  any sole proprietor, partnership, or corporation\npossessing an elevator contractor license issued by the department and who is\nengaged  in the business of erecting, constructing, installing, altering, servicing,\nrepairing, or maintaining elevators or fixed guideway systems;\n(18) \"Elevator mechanic\" means any person who:\n(a) Possesses an elevator mechanic license issued by the department;\n(b) Is employed by an elevator contractor; and\n(c) Is  engaged  in erecting, constructing, installing, altering, servicing,\nrepairing, or maintaining elevators or fixed guideway systems;\n(19) \"Elevator helper\" or \"elevator apprentice\" means any person who works under\nthe general supervision of a licensed elevator mechanic. An elevator helper or\nelevator apprentice is not subject to licensure;\n(20) \"Commissioner\" means  the commissioner of the Department of Housing,\nBuildings and Construction;\n(21) \"Direct and  immediate supervision\" means  that the licensed supervising\nauthority is on site. The supervisor is not required to have actual or direct sight\nof the person being directly supervised;\n(22) \"General supervision\" means that the supervising authority oversees the work\nperformed overall but is not required to be on-site at all times during work\nrelating to elevators or fixed guideway systems;\n(23) \"Accessibility and residential elevator mechanic\" means any person who:\n(a) Possesses  an accessibility and residential elevator mechanic license\nissued by the department;\n(b) Is employed by an elevator contractor; and\n(c) Is  engaged  in erecting, constructing, installing, altering, servicing,\nrepairing, or maintaining accessibility lifts and  private residential\nelevators;\n(24) \"Accessibility lift\" means a hoisting and lowering mechanism, that moves within\na  guide system, serving two (2) or more  landings, for the purpose of\ntransporting a person; and\n(25) \"Private residential elevator\" means  a passenger elevator installed within a\nstructure subject to the Kentucky Residential Code as established in 815 KAR\n7:125, but shall not be shared by units if installed in a multifamily dwelling.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46911","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:51Z","sha256":"2031921eaf263a46bac4d9cd1290154304b67e117388c364df2620146ea6dde4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.330","next":"us-ky/krs-198b.4003"},"notice":"GroundRules: Original legal text.
