{"data":{"id":"us-ky/krs-198b.4023","jurisdiction":"us-ky","citation":"KRS 198B.4023","heading":"Renewal, expiration, termination, and reinstatement of license","body":"issued under KRS  198B.400 to 198B.540 -- Inactive license.\n(1) A  person licensed under KRS  198B.400 to 198B.540 shall annually, on or\nbefore the last day of the licensee's birth month, renew his or her license.\n(2) A sixty (60) day grace period shall be allowed after the anniversary date of the\nlicense, during which time a licensee may continue to practice and may renew\nhis or her license upon  meeting the requirements promulgated through\nadministrative regulations by the department.\n(3) A license not renewed before the end of the sixty (60) day grace period shall\nterminate based on the failure of the licensee to renew in a timely manner.\nUpon  termination of a license, the licensee shall be ineligible to practice in the\nCommonwealth.\n(4) After the sixty (60) day grace period, a former licensee with a terminated\nlicense may  have the license reinstated upon  meeting the requirements\npromulgated  through administrative regulations by  the department. An\napplicant for reinstatement after termination of the license shall not be required\nto  submit to any  examination as  a  condition for reinstatement, if the\nreinstatement application is made  within three (3) years from the date of\ntermination.\n(5) A suspended license shall be subject to expiration and termination and shall be\nrenewed  as provided in this section. Renewal shall not entitle the licensee to\nengage in the practice until the suspension has ended or is otherwise removed\nby the department and the right to practice is restored by the department.\n(6) A revoked license shall be subject to reinstatement, expiration, or termination\nbut shall not be renewed.\n(7) An  applicant for renewal or reinstatement of a license shall show evidence of\ncompleting at least eight (8) hours of continuing education provided by the\nNational Elevator Industry Educational Program, National Association of\nElevator Contractors, or another provider approved by the department. The\ndepartment  shall promulgate administrative regulations establishing the\npermissible content of continuing education programs and the qualifications of\nthe providers.\n(8) When  applicable, an applicant for renewal or reinstatement of an elevator\ncontractor license shall submit proof that the applicant has complied with\nworkers' compensation and unemployment insurance laws and administrative\nregulations and has obtained general liability coverage of at least one million\ndollars ($1,000,000) for injury or death of any number of persons in any one (1)\noccurrence, with coverage of at least five hundred thousand dollars ($500,000)\nfor property damage in any one (1) occurrence.\n(9) The department may, through the promulgation of administrative regulations:\n(a) Establish an inactive license for licensees who are not actively engaging\nin the elevator or fixed guideway system business, but who  wish to\nmaintain their license;\n(b) Determine continuing education requirements for reactivation;\n(c) Waive  the insurance requirements established in subsection (8) of this\nsection for inactive licensees; and\n(d) Establish reactivation procedures.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46914","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:51Z","sha256":"1fef3fc8e23c1f2cf1e426c7743f8ce303b9a210637d62c3afc8c03ce1075064","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.4021","next":"us-ky/krs-198b.4025"},"notice":"GroundRules: Original legal text.
