{"data":{"id":"us-ky/krs-198b.4031","jurisdiction":"us-ky","citation":"KRS 198B.4031","heading":"Disciplinary hearings -- Summary suspension -- Elevator or fixed","body":"guideway system work by unlicensed individual -- Cease-and-desist order.\n(1) The department shall conduct disciplinary hearings in accordance with KRS\nChapter 13B.\n(2) The commissione r may summarily suspend a license for up to ninety (90) days\nbefore a final adjudication or during an appeal of the commissioner's determination\nif he or she believes that allowing the licensee to keep an active license would\nrepresent a clear and immediat e danger to the public's health, safety, or property if\nthe licensee is allowed to continue working.\n(3) The commissioner shall issue a letter to cease and desist with notice of opportunity\nto be heard in accordance with a KRS Chapter 13B hearing, to any i ndividual if the\ncommissioner determines that:\n(a) An individual is not licensed under the provisions of this chapter; and\n(b) The individual is engaged in, or believed to be engaged in, activities for which\nan elevator contractor's or elevator mechanic's license is required under KRS\n198B.400 to 198B.540.\n(4) After completion of the KRS Chapter 13B hearing, if it is determined that the\nindividual's activities are subject to licensure under KRS 198B.400 to 198B.540, the\ncommissioner shall issue a cease -and-desist order that identifies the individual and\nspecifically states the activities that are subject to the order.\n(5) A cease-and-desist order issued under this section shall be enforceable in the Circuit\nCourt of the county of the licensee's place of busi ness in accordance with KRS\nChapter 13B.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36601","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:51Z","sha256":"a24afef29e1a7b5274ed20881153764d3b67a56e8d37eadcedfa523e37cf078b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.4029","next":"us-ky/krs-198b.4033"},"notice":"GroundRules: Original legal text.
