{"data":{"id":"us-ky/krs-198b.4033","jurisdiction":"us-ky","citation":"KRS 198B.4033","heading":"Suspension, revocation, or nonrenewal of license -- Grounds -- Hearing","body":"-- Appeal.\n(1) Subject to a hearing conducted in accordance with KRS Chapter 13B, the\ncommissioner may suspend, revoke, or refuse to renew the license of an elevator\ncontractor or elevator mechanic for any of the following actions by the licensee:\n(a) Use of false evidence or misrepresentation in an application for an elevator\ncontractor's or elevator mechanic's license;\n(b) Attempting to transfer authority granted to the licensed contractor or mechanic\nto another individual;\n(c) Incompetency or negligence relating to elevator service, installation, repair, or\nmaintenance as determined by the commissioner;\n(d) Conviction of a felony after July 1, 2011;\n(e) Fraudulent or dishonest practices while engaging in the business of elevator\nservice, installation, repair, or maintenance;\n(f) Aiding or abetting any person attempting to evade the provisions of KRS\n198B.400 to 198B.540; or\n(g) Violating any provision of KRS 198B.400 to 198B.540  or the administrative\nregulations promulgated under KRS 198B.400 to 198B.540.\n(2) Subject to a hearing in accordance with KRS Chapter 13B, the commissioner shall\nrevoke the license of an elevator contractor or elevator mechanic who continues to\nwork as if  holding a valid license during a suspension imposed by the\ncommissioner.\n(3) Any licensee who is aggrieved by a final order of the commissioner, resulting in the\nsuspension, refusal to renew, or revocation of his or her license may appeal to the\nCircuit C ourt of the county of the licensee's place of business in accordance with\nKRS Chapter 13B.\n(4) Any reason for licensee discipline under subsection (1) of this section may also\nserve as the reason to deny an initial application for licensure as an elevator\ncontractor or elevator mechanic.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36603","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:51Z","sha256":"6c322941e52a2e03fdd754bb39b9adfac590aa950241fa532cf5ac1fae52bab5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.4031","next":"us-ky/krs-198b.4035"},"notice":"GroundRules: Original legal text.
