{"data":{"id":"us-ky/krs-198b.490","jurisdiction":"us-ky","citation":"KRS 198B.490","heading":"Administrative regulations -- Review of standards -- Consistency","body":"with building code.\n(1) The  department shall make, alter, amend, or repeal rules and administrative\nregulations exclusively for the safety and inspection of passenger elevators\nand  fixed guideway systems. The department shall have the authority to\nprescribe, by administrative regulation, a reasonable fee to be charged for\neach inspection. All fees established and regulated by this section shall be paid\nto the department, made  payable to the Kentucky State Treasurer, except as\nmay  be provided in a specific written agreement between the commissioner\nand any agency authorized to inspect elevators or fixed guideway systems by\nthis chapter.\n(2) The  department shall consult with engineering authorities and organizations\nconcerned with standard safety codes, rules, and administrative regulations\ngoverning the operation, maintenance, servicing, construction, alteration,\ninstallation, and inspection of elevators and fixed guideway systems, and the\nqualifications that are necessary for an elevator mechanic, contractor, and\ninspector.\n(3) The  department shall promulgate administrative regulations establishing the\napproved  equipment  regulated by  KRS  198B.400  to 198B.540. These\nadministrative regulations shall include the following, except as modified under\nsubsection (4) of this section:\n(a) Safety Code for Elevators and Escalators, ASME  A17.1/CSA B44;\n(b) Safety Code for Existing Elevators and Escalators, ASME  A17.3;\n(c) Performance-Based  Safety Code  for Elevators and Escalators, ASME\n17.7/CSA B44.7;\n(d) Safety Standards for Platform Lifts and Stairway Chairlifts, ASME  A18.1;\n(e) Standard for the Qualification of Elevator Inspectors, ASME  OEI-1; and\n(f) Automated People Mover Standards, ASCE  21.\n(4) The  department and the committee shall review the latest editions of any\nstandard listed in subsection (3) of this section within twelve (12) months of\nthat standard's effective date. Upon completion of reviews, the committee shall\ngive the department its recommendations, after which the department may\nadopt or modify the standard.\n(5) All administrative regulations issued by the department relating to KRS\n198B.400  to 198B.540 shall be consistent with the standards of safety as\nestablished in 815  KAR  10:060 and  the Uniform State Building Code\nestablished in KRS 198B.050.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46920","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:52Z","sha256":"034e4c1061a0af7e8dd350c8221485bbcd635b98d4f579867bc94e6c8bb01b45","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.480","next":"us-ky/krs-198b.500"},"notice":"GroundRules: Original legal text.
