{"data":{"id":"us-ky/krs-198b.520","jurisdiction":"us-ky","citation":"KRS 198B.520","heading":"Permits for erection or repairs -- Revocation or expiration of permit --","body":"Extension for good cause.\n(1) Before any new installation of an elevator or fixed guideway system of permanent\nnature shall be erected or before any existing elevator is remov ed to a different\nlocation, an application of specifications in duplicate shall be submitted to the\ndepartment giving such information concerning the construction, installation, and\noperation of the elevator or fixed guideway system as the department may r equire\non forms to be furnished by the department, together with complete construction\nplans in duplicate. In all cases where any changes or repairs are made which alter its\nconstruction or classification, grade, or rated lifting capacity, except when made\npursuant to a report of an inspector, an application of specifications in duplicate\nshall be submitted to the department containing such information for approval.\nUpon approval of the application and construction plans, the department shall issue\na permit for the erection or repair of the elevator or fixed guideway system. No new\nelevator or fixed guideway system shall be operated until completion in accordance\nwith the approved plans and specifications, unless a temporary permit is granted by\nthe department.\n(2) A permit issued under this section may be revoked by the department when:\n(a) A false statement or misrepresentation of a material fact in the application,\nplans, or specifications led to the issuance of the permit;\n(b) The permit was issued in error;\n(c) The work detailed under the permit is not being performed in accordance with\nthe application, plans, or specifications;\n(d) Work is not being performed in accordance with the code or conditions of the\npermit; or\n(e) The elevator contractor to whom the permit was issued fails or refuses to\ncomply with a lawfully issued stop work order.\n(3) A permit issued under this section shall expire if:\n(a) The work authorized by permit is not commenced within twenty -four (24)\nmonths after the date of issuance, o r within a shorter period of time as\nspecified by the department at the time the permit is issued; or\n(b) The work is abandoned for a period of sixty (60) days after work commences,\nor a shorter period of time as specified by the department at the time the\npermit is issued.\n(4) The department shall allow an extension of the allotted period if proof of good\ncause is provided with a request for an extension.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=36621","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:52Z","sha256":"1cac5667fd59fd7bfaaf3502e5a543fa0c7ffbe1e4600c32a8367bb7c2d25c11","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.510","next":"us-ky/krs-198b.530"},"notice":"GroundRules: Original legal text.
