{"data":{"id":"us-ky/krs-198b.540","jurisdiction":"us-ky","citation":"KRS 198B.540","heading":"Notice of defective machinery -- Sealing of dangerous  passenger","body":"elevator or fixed guideway system.\n(1) If the department's inspector of elevators and fixed guideway systems or a\ngeneral inspector of elevators or fixed guideway  systems  finds that a\npassenger elevator, fixed guideway system, or a part thereof does not afford\nreasonable safety, the department or the general inspector shall post a notice\nupon  the elevator or fixed guideway system prohibiting further use of the\nelevator or fixed guideway system until the changes or alterations set forth in\nthe notice have been made  to the satisfaction of the department or the\ninspector. The notice shall contain a statement that operators or passengers\nare subject to injury by its continued use, a description of the alteration or other\nchange  necessary to be made  in order to secure safety of operation, date of\nthe notice, and name and signature of the department or inspector issuing the\nnotice.\n(2) If any inspector of elevators or fixed guideway systems finds a passenger\nelevator or fixed guideway system to be so unsafe as can be reasonably\nexpected to offer imminent danger of death or physical injury, that unit shall be\nsealed out of service, a hazard notice posted thereon, and the department shall\nbe notified immediately of the exact location and condition of the unit.\n(3) A  passenger elevator or fixed guideway system, once sealed, shall not be\noperated except for the purpose of effecting repairs and in the manner\nprescribed by the department, until all defects are corrected and the unit has\nbeen inspected and certified as safe by the department.\n(4) Sealing shall consist of rendering a passenger elevator unit or fixed guideway\nsystem inoperable by disconnecting power or by placing a sealing device on\nthe operation switch and ordering additional measures to be effected by the\nowner, such as erection of barricades, as may be required to prevent use of or\npublic access to the unit.\n(5) No seal, notice, or barricade placed on or around an elevator or fixed guideway\nsystem in accordance with this chapter shall be removed, obstructed or in any\nway altered without the written consent of the department.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46921","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:52Z","sha256":"e86a5a34045de684f7a51beea193af27dea978777809463c576c4b41eade7ff8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.530","next":"us-ky/krs-198b.550"},"notice":"GroundRules: Original legal text.
