{"data":{"id":"us-ky/krs-198b.620","jurisdiction":"us-ky","citation":"KRS 198B.620","heading":"Refusal to renew license -- Revocation or suspension of license --","body":"Appeal -- Criminal penalty.\n(1) Subject to a hearing conducted in accordance with KRS  Chapter 13B, the\ncommissioner may refuse to renew or may suspend or revoke the license of a\nlicensed fire protection sprinkler contractor or the certificate of a certificate\nholder to engage in the business of fire protection sprinkler systems or in lieu\nthereof assess an administrative fine not to exceed two thousand dollars\n($2,000) for any of the following reasons:\n(a) Gross  incompetency or gross negligence in the installation, repair,\nalteration, maintenance, inspection, or addition to fire protection sprinkler\nsystems, as determined by the commissioner;\n(b) Conviction of a felony;\n(c) Fraudulent or dishonest practices while engaging in the business of fire\nprotection sprinkler systems;\n(d) Use  of false evidence or misrepresentation in an application for a license\nor certificate;\n(e) Signing or affixing his or her seal to any plans, prints, specifications or\nreports, which have not been prepared by him or her personally or under\nhis or her immediate supervision, or in violation of KRS 198B.585; or\n(f) Knowingly violating any provisions of KRS  198B.550 to 198B.630 or the\nregulations issued thereunder.\n(2) The commissioner shall revoke, subject to a hearing in accordance with KRS\nChapter 13B, the license of a fire protection sprinkler contractor or a certificate\nholder who engages in the fire protection sprinkler system business during a\nsuspension of the license.\n(3) Any  person who  engages  in the drawings, installation, repair, alteration,\nextension, maintenance, or inspection of fire protection sprinkler systems or\nuses any title, sign, card, or device indicating or intending to indicate that he or\nshe  is a certified fire sprinkler contractor without having first obtained the\nrequisite license or certificate shall be guilty of a Class A misdemeanor. Each\nviolation shall be regarded as a separate offense.\n(4) Any  license or certificate holder who  is aggrieved by a final order of the\ncommissioner suspending or revoking a license may  appeal to the Franklin\nCircuit Court or the Circuit Court of the county of the license or certificate\nholder's place of business in accordance with KRS Chapter 13B.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46932","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:52Z","sha256":"d14a8985f15458b4db02e0937d316ea4f0a80a71ff825d7fbb74dd46400b59dc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.615","next":"us-ky/krs-198b.625"},"notice":"GroundRules: Original legal text.
