{"data":{"id":"us-ky/krs-198b.650","jurisdiction":"us-ky","citation":"KRS 198B.650","heading":"Definitions for KRS  198B.650 to 198B.689.","body":"As used in KRS 198B.650 to 198B.689, unless the context requires otherwise:\n(1) \"Air conditioning or cooling system\" means a system in which heat is removed\nfrom air, surrounding surfaces, or both;\n(2) \"Apprentice heating, ventilation, and air conditioning mechanic\" means  an\nindividual in the process of learning the heating, ventilation, and  air\nconditioning trade who  assists and is under the supervision of a master\nheating, ventilation, and air conditioning contractor and a journeyman heating,\nventilation, and air conditioning mechanic;\n(3) \"Burner service\" means the servicing of oil or gas burners used for heating air\nor water for purposes other than the transmission of heat;\n(4) \"Certificate\" means  a document issued by the department to an apprentice\nheating, ventilation, and air conditioning mechanic to assist a master heating,\nventilation, and air conditioning contractor or a journeyman heating, ventilation,\nor air conditioning mechanic;\n(5) \"Commissioner\" means  the commissioner of the Department of Housing,\nBuildings and Construction;\n(6) \"Department\" means the Department of Housing, Buildings and Construction;\n(7) \"Heating system\" means  a system in which heat is transmitted by radiation,\nconduction, convection, or a combination of any of these methods to air,\nsurrounding surfaces, or both. \"Heating system\" does not include fireplaces\nand  free-standing stoves not incorporated into a primary heating system,\nelectric thermal storage units, electric ceiling cable heating systems, or electric\nbaseboard heating units;\n(8) \"Hydronic system\" means  a heating and cooling system using liquids to\ntransmit or remove heat;\n(9) \"Initial heating, ventilation, or air conditioning system\" means  the first or\noriginal heating, ventilation, or air conditioning system installed in a building;\n(10) \"Journeyman  heating, ventilation, and air conditioning mechanic\" means  an\nindividual who is licensed by the department to perform heating, ventilation,\nand air conditioning work under the supervision, direction, and responsibility of\na master heating, ventilation, and air conditioning contractor;\n(11) \"Maintenance person or maintenance engineer\" means  a person who  is a\nregular and bona fide employee of a property owner, property lessor, property\nmanagement  company,  or firm, not in the heating, ventilating, and  air\nconditioning business that has jurisdiction of property where  the routine\nmaintenance of heating, ventilating, and air conditioning is being performed,\nprovided the maintenance shall not include major repairs;\n(12) \"Major repair\" means the complete replacement of any of the following heating,\nventilation, or air conditioning equipment:\n(a) Furnaces;\n(b) Condensing units;\n(c) Heat pumps;\n(d) Fan coil units;\n(e) Chiller systems; or\n(f) Heating boiler systems not covered by KRS Chapter 236;\n(13) \"Master heating, ventilation, and air conditioning contractor\" means a heating,\nventilation, and air conditioning contractor who is licensed by the department to\nadvertise and practice heating, ventilation, and air conditioning contracting in\nthis Commonwealth;\n(14) \"Permit\" means a document issued by the department or its authorized agent\nallowing the installation of an original heating, ventilation, or air conditioning\nsystem;\n(15)(a) \"Practice of heating, ventilation, and air conditioning contracting\" means\nthe installation, maintenance, altering, remodeling, or repair of heating\nsystems, ventilation systems, hydronic systems, burner service, or cooling\nsystems.\n(b) \"Practice of heating, ventilation, and air conditioning contracting\" does not\ninclude cleaning of duct work. If cleaning of duct work involves cutting an\naccess point or hole into a duct, the access point or hole shall be repaired\nand resealed in such a manner that the integrity of the duct is restored\nbefore the cleaning service is concluded.\n(c) Nothing in this subsection shall be taken to prohibit a person licensed\nunder KRS  198B.650 to 198B.689 from performing the cleaning of duct\nwork;\n(16) \"Routine maintenance of heating, ventilation, or air conditioning\" means  the\nroutine and periodic servicing of heating, ventilation, and air conditioning\nsystems, including cleaning, inspection, and adjustments to ensure the proper\noperation, and the removal and replacement of component  parts. \"Routine\nmaintenance of heating, ventilation, or air conditioning\" shall not include major\nrepairs; and\n(17) \"Ventilation system\" means a natural or mechanical system of supplying air to\nor removing air from any space.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52146","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:52Z","sha256":"887f1a959b8566807693ac113f9b0f471eeebe6ce974b91f7e347f31e4dcd6aa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.6417","next":"us-ky/krs-198b.652"},"notice":"GroundRules: Original legal text.
