{"data":{"id":"us-ky/krs-198b.6673","jurisdiction":"us-ky","citation":"KRS 198B.6673","heading":"Administrative regulations -- Fees -- Qualifications for and","body":"compensation of local government's inspectors -- Local governments\nprohibited from establishing additional permitting or inspection programs.\n(1) The department shall promulgate adm inistrative regulations to establish a\nreasonable schedule of fees to implement the program. The fees shall not exceed the\nactual costs for the administration of the program. The department shall also\nestablish heating, ventilation, and air conditioning in spection protocols that ensure\ntimely inspections and minimal interruption to the construction process.\n(2) The department, upon the request of any individual local governing entity or\ncombination of entities with existing heating, ventilation, and air con ditioning\npermitting and inspection programs as of January 1, 2007, shall authorize them to\nadminister, carry out, and enforce the administrative regulations of the department\nrelating to heating, ventilation, and air conditioning installations, issue perm its, and\nmake inspections within their respective boundaries, or perform any portion of these\nfunctions. Nothing in KRS 198B.6671 to 198B.6678 shall prohibit these entities\nfrom continuing to include major repairs or substantial alterations to a heating,\nventilation, or air conditioning system within their permitting and inspection\nprogram in the absence of a state requirement, if major repairs or substantial\nalterations were included in the entities' inspection program prior to January 1,\n2007. The department may authorize any other individual local government entities\nor combination of entities to administer, carry out, and enforce the administrative\nregulations of the department relating to heating, ventilation, and air conditioning\ninstallations, issue p ermits, and make inspections within their respective\nboundaries, or perform any portion of those functions. When authorization is\ngranted, the department shall enter into contractual arrangements with the local\ngoverning entities, which shall remain in eff ect as long as the local entity continues\nto operate its program pursuant to guidelines adopted by the department. A heating,\nventilation, and air conditioning permit issued by an authorized local governing\nentity shall be considered a permit issued by the  department, and all fees collected\nby the authorized local government related to the same shall be retained by that\nlocal government.\n(3) Any local governing entity enforcing the permitting and inspection requirements of\nKRS 198B.650 to 198B.689 pursuant to subsection (2) of this section may appoint\nand fix the compensation of the local governing entity's heating, ventilation, and air\nconditioning inspectors. No person shall perform the duties of a heating, ventilation,\nand air conditioning inspector unles s he or she has at least six (6) years' experience\nas a licensed heating, ventilation, and air conditioning journeyman mechanic or a\nlicensed master heating, ventilation, and air conditioning contractor, unless he or\nshe is a certified building inspector w ho has successfully passed the examinations\nrelating to heating, ventilation, and air conditioning systems. At the time of\nemployment, the heating, ventilation, and air conditioning inspector shall be\nlicensed or certified in accordance with KRS 198B.650 t o 198B.689, or become\ncertified within twelve (12) months of employment.\n(4) No local governing entity shall impose any other additional heating, ventilation, and\nair conditioning inspection or permit requirements, or establish any local inspection\nor perm itting program, unless those provisions were in place before January 1,\n2007.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48593","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:52Z","sha256":"c54cd92b96efbfe13ff7dba5dcd50810d2c56113a8224e696c8f4730dbd4cff4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.6672","next":"us-ky/krs-198b.6674"},"notice":"GroundRules: Original legal text.
