{"data":{"id":"us-ky/krs-198b.6675","jurisdiction":"us-ky","citation":"KRS 198B.6675","heading":"Powers of department and of authorized local governments to inspect","body":"systems -- Powers to restrain and enjoin violations of KRS 198B.650 to\n198B.689 -- Representation of department by state and local prosecutors.\n(1) For the purpose of enforcing the provisions of KRS 198B.650 to 198B.689, officers,\nagents, and inspectors of the department or an authorized local government shall\nhave the power and authority to enter upon permitted premises at all reasonable\ntimes with the consent of the property owner in order to make inspections, interview\nall persons, and request proof of heating, ventilation, and air conditioning licenses,\ninstallation permits, and other evidence of compliance. Officers, agents, and\ninspectors of the department or an authorized local  government shall have the\nauthority to issue a stop -work order to any owner, agent, or occupant of real\nproperty whenever the heating, ventilation, and air conditioning system under\ninspection is found to be in violation of KRS 198B.650 to 198B.689 or the  Uniform\nState Building Code's heating, ventilation, and air conditioning mechanical sections.\n(2) Notwithstanding the existence or pursuit of any other civil or criminal penalties, the\ndepartment and its officers, agents, and inspectors are authorized to institute and\nmaintain actions to restrain and enjoin any violation of KRS 198B.650 to 198B.689,\nthe Uniform State Building Code, the Uniform State Residential Code, or the rules\nor the administrative regulations of the department relating thereto.\n(3) City and county attorneys, Commonwealth's attorneys, and the Attorney General\nmay, within their respective jurisdictions, represent the department and its officers,\nagents, and inspectors in the enforcement of provisions of KRS 198B.650 to\n198B.689, the Unifo rm State Residential Code, and the Uniform State Building\nCode.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7063","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:52Z","sha256":"ce9a0bc30d71b2e43a5885f83039ddd68dac8225cbecb6040c65a75d5d0ce774","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.6674","next":"us-ky/krs-198b.6676"},"notice":"GroundRules: Original legal text.
