{"data":{"id":"us-ky/krs-198b.702","jurisdiction":"us-ky","citation":"KRS 198B.702","heading":"Exemptions from requirements of KRS 198B.700 to 198B.738.","body":"KRS 198B.700 to 198B.738 shall apply to an individual who conducts home inspections\nfor compensation, but shall not apply to the following:\n(1) An individual who is acting within the scope of the individual's employment as:\n(a) A code enforcement official for the state or a political subdivision of the state;\nor\n(b) A representative of a state or local housing agency or an individual acting\nunder the authority of the United States Depa rtment of Housing and Urban\nDevelopment;\n(2) An individual who is acting within the scope of the individual's license as a\nlicensed:\n(a) Architect under KRS Chapter 323;\n(b) Professional engineer under KRS Chapter 322;\n(c) Plumbing contractor or journeyman plumber under KRS Chapter 318;\n(d) Electrician, master electrician, or electrical contractor under KRS Chapter\n227A;\n(e) Liquefied petroleum gas dealers under KRS Chapter 234;\n(f) Master heating, ventilation, and air conditioning contractor, journeyman\nheating, ventilation, and air conditioning mechanic, or an apprentice heating,\nventilation, and air conditioning mechanic under this chapter; or\n(g) Fire protection sprinkler contract or, fire protection system certificate holder,\nor certified fire sprinkler inspector under this chapter;\n(3) An individual licensed under KRS Chapter 324 as a real estate broker, broker -\nsalesperson, or salesperson and is acting within the scope of the individual's license;\n(4) An individual who is licensed under KRS Chapter 324A as a real property appraiser\nand is acting within the scope of the individual's license;\n(5) An individual who holds a license under KRS Chapter 304 as an insurance adjuster\nand is acting within the scope of the individual's license;\n(6) An individual who holds a permit, certificate, or license to:\n(a) Use and apply pesticides; or\n(b) Make diagnostic inspections and reports for wood destroying pests and fungi\nunder KRS Chapter 217B a nd is acting within the scope of the individual's\ncertificate or license;\n(7) An individual who holds a license from a political subdivision as a tradesperson or\nhome builder and is acting within the scope of the individual's license;\n(8) An individual who  holds a current and valid license, certificate, or permit under\nKRS 227.550 to 227.660 and is acting within the scope of the individual's license,\ncertificate, or permit as a:\n(a) Manufactured home retailer;\n(b) Manufactured home certified retailer; or\n(c) Manufactured home certified installer; or\n(9) A person not subject to licensure by the Commonwealth who is engaged in\nproviding estimates for remodeling or repair to a residential dwelling.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58037","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:52Z","sha256":"f8f647f20890311342cbf7918f851dd889ca9f82e2029edc725497549444fc44","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.700","next":"us-ky/krs-198b.704"},"notice":"GroundRules: Original legal text.
