{"data":{"id":"us-ky/krs-198b.706","jurisdiction":"us-ky","citation":"KRS 198B.706","heading":"Duties and powers of board.","body":"The board shall:\n(1) Through the promulgation of administrative regulations:\n(a) Determine the requirements for and prescribe the form of licenses,\napplications, and other documents that are required by KRS 198B.700 to\n198B.738; and\n(b) Require that a home inspection report in clude a statement that the home\ninspection report does not address environmental hazards and list all other\nexclusions with specificity;\n(2) Grant, deny, suspend, and revoke approval of examinations and courses of study\nregarding home inspections;\n(3) Issue or deny applications for licensure and renewals;\n(4) Investigate complaints concerning licensees, or persons the board has reason to\nbelieve should be licensees, including complaints concerning failure to comply with\nKRS 198B.700 to 198B.738 or administr ative regulations promulgated under KRS\n198B.700 to 198B.738, and, when appropriate, take action in accordance with KRS\n198B.728 and 198B.730;\n(5) Bring actions in the name of the state in an appropriate court in order to enforce\ncompliance with KRS 198B.7 00 to 198B.738 or the administrative regulations\npromulgated under KRS 198B.700 to 198B.738;\n(6) Establish license fees in an amount not to exceed two hundred fifty dollars ($250)\nannually;\n(7) Inspect the records of a licensee in accordance with administrative regulations\npromulgated by the board;\n(8) Conduct or designate a member or other representative to conduct public hearings\non any matter for which a hearing is required under KRS 198B.728 and 198B.730;\n(9) Adopt a seal containing the words \"Kentucky Board of Home Inspectors\" and,\nthrough the board's secretary, certify copies and authenticate all acts of the board;\n(10) Use counsel, consultants, and other persons, enter into contracts, and a uthorize\nexpenditures that are reasonably necessary or appropriate to administer and enforce\nKRS 198B.700 to 198B.738 and administrative regulations promulgated\nthereunder;\n(11) Establish continuing education requirements for licensed home inspectors in\naccordance with KRS 198B.722 and 198B.724;\n(12) Conduct disciplinary actions against licensees to include:\n(a) Suspension, probation, or permanent revocation of a license;\n(b) Requiring a licensee to obtain additional continuing education; and\n(c) Issuance of a written reprimand;\n(13) Require all fee -paid home inspections to be conducted in accordance with the\nstandards of practice of:\n(a) The American Society of Home Inspectors;\n(b) The International Association of Certified Home Inspectors; or\n(c) Any other  approved standards of practice that are equal to the standards of\npractice of the organizations in paragraphs (a) and (b) of this subsection as\ndetermined by the board.\nThe board may establish standards of practice for home inspectors licensed in\nKentucky at a later date, which will supersede any other standards of practice\npreviously adopted by the board and, if adopted by regulation, the standards in\nparagraphs (a) and (b) of this subsection;\n(14) Exercise all other powers specifically conferred on the board under KRS 198B.700\nto 198B.738; and\n(15) Promulgate administrative regulations in accordance with KRS Chapter 13A to\ncarry out the effective administration and the requirements of KRS 198B.700 to\n198B.738, following review by the director of the Divi sion of Real Property\nBoards.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55517","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:52Z","sha256":"ae34122dbd7f922a78128d0126f6633534ef4b2e46dd4975e0c32bd0032696f9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.704","next":"us-ky/krs-198b.708"},"notice":"GroundRules: Original legal text.
