{"data":{"id":"us-ky/krs-198b.730","jurisdiction":"us-ky","citation":"KRS 198B.730","heading":"Disciplinary hearings -- Emergency suspension -- Persons not licensed to","body":"show cause -- Cease and desist order.\n(1) The procedures set forth in KRS Chapter 13B shall govern the board's conduct of\ndisciplinary hearings.\n(2) The board may summarily suspend a license for up to ninety (90) days before a final\nadjudication or during an appeal of the board's determination if the board finds that\nthe licensee would represent a clear and immediate danger to the public's health,\nsafety, or property if allowed t o perform home inspections. The summary\nsuspension may be renewed upon a hearing before the board for up to ninety (90)\ndays.\n(3) If the board:\n(a) Determines that an individual is not licensed under KRS 198B.700 to\n198B.738 and is engaged in or believed to be engaged in activities for which a\nlicense is required under KRS 198B.700 to 198B.738, the board shall issue an\norder to that individual requiring the individual to show cause why the\nindividual should not be ordered to cease and desist from the activi ties. The\nshow cause order shall set forth a date, time, and place for a hearing at which\nthe individual shall appear and show cause why the individual should not be\nsubject to licensing under KRS 198B.700 to 198B.738;\n(b) Prior to a hearing, the board may  issue a cease and desist order that identifies\nthe individual and describes activities that are the subject of the order.\n(4) A cease and desist order issued under this section shall be enforceable in a Circuit\nCourt of the Commonwealth.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39907","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:52Z","sha256":"8b828931e5c3e98efdc572020800645c1e0c699cdb2b5fdbc8cc4b92ab1f32e8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.728","next":"us-ky/krs-198b.732"},"notice":"GroundRules: Original legal text.
