{"data":{"id":"us-ky/krs-198b.732","jurisdiction":"us-ky","citation":"KRS 198B.732","heading":"Prohibited activities -- Penalties -- Burden of proof.","body":"(1) An individual is guilty of a Class B misdemeanor if the individual:\n(a) Performs or offers to perform home inspections for compensation in Kentucky\nwithout being licensed as a home inspector and without being exempt from\nlicensing;\n(b) Presents as the individual's own the license of another;\n(c) Intentionally gives false or materially misleading information to the board or\nto a board member in connection with a licensing matter;\n(d) Impersonates another licensee; or\n(e) Uses an expired, suspended, revoked, or otherwise restricted license.\n(2) An individual is guilty of a Class A misdemeanor if the individual is convicted of a\nsecond or subsequent offense under this section within five (5) years of a prior\nconviction of an offense under this section.\n(3) When entering a judgment for an offense under this section, the court shall impose a\nservice fee of an amount equal to any fee or other compensation earned by the\nindividual in the commission of the offense.\n(4) Each transaction involving unauthorized activiti es as described in this section shall\nconstitute a separate offense.\n(5) In all actions for the collection of a fee or other compensation for performing home\ninspections, the party seeking relief shall allege and prove that, at the time that the\ncause of a ction arose, the party seeking relief was not in violation of KRS\n198B.712.","path":["KRS Chapter 198B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39908","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:52Z","sha256":"d597faadb94623f2d00d9baa89bdd96adcf9ea4e150653d0c794d10ec14cb6ce","source_id":"us-ky","stale":false,"prev":"us-ky/krs-198b.730","next":"us-ky/krs-198b.734"},"notice":"GroundRules: Original legal text.
