{"data":{"id":"us-ky/krs-199.590","jurisdiction":"us-ky","citation":"KRS 199.590","heading":"Prohibited acts and practices in adoption of children -- Expenses paid by","body":"prospective adoptive parents to be submitted to court.\n(1) A person, corporation, or association shall not advertise in any manner that it will\nreceive children for the purpose of adoption. A newspaper published in the\nCommonwealth of Kentucky or any other publication which is prepared, sold, or\ndistributed in the Commonwealth of Kentucky shall not contain an advertisement\nwhich solicits children for adoption or solicits the custody of children.\n(2) A person, agency, institution, or intermediary shall not sell or purchase or procure\nfor sale or purchase any child for the purpose of adoption or any other purpose,\nincluding termination of parental rights. This section shall not proh ibit a child -\nplacing agency from charging a fee for adoption services. This section shall not be\nconstrued to prohibit in vitro fertilization. For purposes of this section, \"in vitro\nfertilization\" means the process by which an egg is removed from a woman,  and\nfertilized in a receptacle by the sperm of the husband of the woman in whose womb\nthe fertilized egg will thereafter be implanted.\n(3) No person, association, or organization, other than the cabinet or a child -placing\ninstitution or agency shall place a child or act as intermediary in the placement of a\nchild for adoption or otherwise, except in the home of a stepparent, grandparent,\nsister, brother, aunt, or uncle, or upon written approval of the secretary. This\nsubsection shall not be construed to li mit the Cabinet for Health and Family\nServices in carrying out its public assistance under Title IV -A of the Federal Social\nSecurity Act program in accordance with KRS Chapter 205. This section shall not\nbe construed to prohibit private independent adoptio n or the right to seek legal\nservices relating to a private independent adoption.\n(4) A person, agency, institution, or intermediary shall not be a party to a contract or\nagreement which would compensate a woman for her artificial insemination and\nsubsequent termination of parental rights to a child born as a result of that artificial\ninsemination. A person, agency, institution, or intermediary shall not receive\ncompensation for the facilitation of contracts or agreements as proscribed by this\nsubsection. Contracts or agreements entered into in violation of this subsection shall\nbe void.\n(5) A person, organization, group, agency, or any legal entity, except a child -placing\nagency, shall not accept any fee for bringing the adoptive parents together with the\nchild to be adopted or the biological parents of the child to be adopted. This section\nshall not interfere with the legitimate practice of law by an attorney.\n(6) (a) In every adoption proceeding, the expenses paid, including but not limited to\nany fees for legal services, placement services, and expenses of the biological\nparent or parents, by the prospective adoptive parents for any purpose related\nto the adoption shall be submitted to the court, supported by an affidavit,\nsetting forth in detail a listing  of expenses for the court's approval or\nmodification.\n(b) In the event the court modifies the expense request as it relates to legal fees\nand legal expenses only, the attorney for the adoptive parents shall not have\nany claim against the adoptive parents for the amount not approved.","path":["KRS Chapter 199"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7197","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:54Z","sha256":"7aeee98f9a0803462e4821caa26df68e0dee1dde2766ee3e7904a6b16acef499","source_id":"us-ky","stale":false,"prev":"us-ky/krs-199.585","next":"us-ky/krs-199.595"},"notice":"GroundRules: Original legal text.
