{"data":{"id":"us-ky/krs-199.665","jurisdiction":"us-ky","citation":"KRS 199.665","heading":"Performance-based contracting for child-caring facilities and child-placing","body":"agencies -- Study group -- Implementation -- Administrative regulations.\n(1) As used in this section, unless the context otherwise requires;\n(a) \"Cabinet\" means the Cabinet for Health and Family Services;\n(b) \"Performance-based contracting\" means an approach that stresses permanency\noutcomes for children and utilizes a payment structure that reinforces provider\nagencies' efforts to offer services that improve the outcomes for children; and\n(c) \"Secretary\" means the secretary of the Cabinet for Health and Family\nServices.\n(2) The secretary shall designate a study group to make recommendations regarding the\ncreation and implementation of performance -based contracting for licensed child -\ncaring facilities and child-placing agencies in the Commonwealth.\n(3) The study group shall be composed of the following members:\n(a) The secretary;\n(b) The commissioner for the Department for Community Based Services;\n(c) The director of the Administrative Office of the Courts, or designee;\n(d) The executive director of the Governor's Office of Early Childhood, or\ndesignee;\n(e) One (1) adult who was a former foster child in the Commonwealth;\n(f) One (1) adult who is a current or former foster parent in the Commonwealth;\n(g) Two (2) employees of a licensed child-placing agency;\n(h) Two (2) employees of a licensed child-caring facility; and\n(i) Any personnel within the Department for Community Based Services that the\nsecretary deems necessary.\n(4) In its deliberations, the study group shall include but not be limited to analysis of\nimproved timeliness and likelihood of permanency su ch as reunification, adoption,\nor guardianship; fewer moves for children in foster care; and reduced instances of\nreentry into care.\n(5) The study group shall report its recommendations by December 1, 2018. The study\ngroup shall cease to operate after the delivery of the recommendations required by\nthis subsection.\n(6) By July 1, 2019, the cabinet shall:\n(a) Establish and implement performance -based contracting for licensed child -\ncaring facilities and child -placing agencies that contract with the department\nfor services; and\n(b) Apply and implement all standards, processes, and procedures established for\nperformance-based contracting for licensed child -caring facilities and child -\nplacing agencies in accordance with paragraph (a) of this subsection to all\nother cabinet-operated programs that are like those operated by child -caring\nfacilities and child-placing agencies.\n(7) The cabinet shall promulgate administrative regulations to implement this section.","path":["KRS Chapter 199"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53681","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:54Z","sha256":"b871bcf27241b1bbdcffb17152c5407f750aaebbc076a59a075d3bbe86d3d539","source_id":"us-ky","stale":false,"prev":"us-ky/krs-199.660","next":"us-ky/krs-199.670"},"notice":"GroundRules: Original legal text.
