{"data":{"id":"us-ky/krs-199.670","jurisdiction":"us-ky","citation":"KRS 199.670","heading":"Denial, suspension, or revocation of license of child -caring facilities or","body":"child-placing agencies.\n(1) The cabinet may revoke or suspend a license issued under KRS 199.640 for any\ndeficiency or condition which would have caused a denial of the license in the first\ninstance. The cabinet may refuse to issue a license in any case where the applicant\nis not found to meet the standards established by the secretary in an administrative\nregulation promulgated in accordance with the provisions of KRS 199.640.\n(2) If the cabinet proposes to revoke or suspend, or to refuse to issue a license, written\nnotice shall be given to the licensee or applicant, stating the proposed action and\ngrounds for the action, and notifying the licensee or applicant that t he license will\nbe revoked, suspended, or refused unless the applicant or licensee makes a written\nrequest to engage in informal dispute resolution, in accordance with the provisions\nof subsection (4) of this section, or the applicant or licensee makes a w ritten request\nto the cabinet within thirty (30) days of notice for a hearing before the Office of\nAdministrative Hearings within the Department of Law. Notice shall be complete\nand effective upon mailing. If the cabinet proposes to deny the issuance or re newal\nof a license, notice of the proposed action shall be provided to the licensee or\napplicant no later than thirty (30) days after the application for licensure or renewal\nis received by the cabinet.\n(3) If a request for a hearing is made, the hearing shall be conducted in accordance with\nKRS Chapter 13B. If the cabinet has probable cause to believe that an immediate\nthreat to the public health, safety, or welfare exists, the cabinet may take emergency\naction pursuant to KRS 13B.125.\n(4) (a) Upon receipt of a statement of deficiency from the cabinet, the applicant or\nlicensee may request one (1) informal opportunity per survey to dispute any\ndeficiencies with which it disagrees. The applicant or licensee shall make a\nwritten request to the cabinet for inf ormal dispute resolution, which must be\nreceived by the cabinet within ten (10) days of the receipt of the statement of\ndeficiency by the applicant or licensee. The request shall:\n1. Specify the deficiencies in dispute;\n2. Provide a detailed explanation of the basis for the dispute;\n3. Include any supporting documentation, including any information that\nwas not available at the time of the survey; and\n4. If desired, request a face -to-face meeting with the regional program\nmanager, or the manager's designee,  and a surveyor who did not\nparticipate in the original survey or the decision to issue the disputed\ndeficiency.\n(b) Upon receipt of a request for informal dispute resolution, the regional\nprogram manager, or the manager's designee, and a child-caring surveyor who\ndid not participate in the original survey or the decision to issue the disputed\ndeficiency shall, within th irty (30) days of receipt of the request, review the\nspecific deficiencies in dispute and notify the applicant or licensee in writing\nof the results of the review. If a face -to-face meeting was requested by the\napplicant or licensee, the meeting shall be h eld, and no decision shall be made\nregarding the disputed deficiencies until after the face -to-face meeting has\noccurred.\n1. If materials submitted by the applicant or licensee by mail or at the face -\nto-face meeting demonstrate that specific deficiencies s hould not have\nbeen cited, those deficiencies will be removed from the statement of\ndeficiencies and any enforcement actions imposed solely as a result of\nthose cited deficiencies will be rescinded.\n2. If, after review of the disputed deficiencies, the reg ional office staff\naffirms the deficiencies, the licensee or applicant may accept the\nfindings of the regional office staff and make any corrections required\nby the cabinet, or may, within thirty (30) days of receipt of the notice,\nrequest in writing a mee ting with the secretary or the secretary's\ndesignee. The secretary may designate an individual who holds the\nposition of director or above to serve as the designee.\n3. The secretary or the secretary's designee shall meet in person with the\nlicensee or appl icant and review the documentation available within\nfifteen (15) days of receipt of the request.\n4. If the information provided demonstrates that specific deficiencies\nshould not have been cited, those deficiencies will be removed from the\nstatement of deficiencies and any enforcement actions imposed solely as\na result of those cited deficiencies will be rescinded.\n5. If the secretary or the secretary's designee affirms the deficiencies, the\nsecretary or the secretary's designee shall, within fifteen (15) d ays issue\na final written order stating the cabinet's final position regarding the\ndeficiencies in dispute. The decision of the secretary or the secretary's\ndesignee shall be a final order for purposes of subsection (5) of this\nsection.\n(c) A request for i nformal dispute resolution shall not delay the required\nsubmission of a plan of correction for any deficiency not in dispute. Any\ncorrective plan of action or similar submission required by the cabinet relating\nto any deficiency in dispute shall be suspend ed until a decision is rendered\nand a corrective plan of action is agreed to within the informal dispute\nresolution process or the secretary or the secretary's designee issues a final\norder.\n(5) Any final order may be reviewed in the Circuit Court of the c ounty in which the\nchild-caring facility or child -placing agency is located in accordance with KRS\nChapter 13B.","path":["KRS Chapter 199"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56591","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:54Z","sha256":"f9d49bd6d8eea80ca57b99b000d27be8c2121c0c0b1d2d3213eedcc073457068","source_id":"us-ky","stale":false,"prev":"us-ky/krs-199.665","next":"us-ky/krs-199.680"},"notice":"GroundRules: Original legal text.
